Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute a Reimbursement Agreement with the City of Antioch for the Empire Avenue Extension North – Phase l, CIP Project No. 336-3151.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute a Reimbursement Agreement with the City of Antioch for the Empire Avenue Extension North – Phase l, CIP Project No. 336-3151.

PREVIOUS ACTION
On April 12, 2005, by Resolution No. 2005-71, City Council approved a Purchase Agreement with East Contra Costa Irrigation District for a portion of property generally located on the east side of Empire Avenue north of Lone Tree Way, for the Empire Avenue Extension North - Phase l, CIP Project No. 336-3151.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program that included the Empire Avenue Extension North – Phase l, CIP Project No. 336-3151.

BACKGROUND
The infrastructure improvements of Empire Avenue north of Lone Tree Way will consist of constructing half an arterial street on the west and 20 feet of pavement on the east, with the associated utilities, power pole relocation and a new traffic signal. These improvements are necessary to support commercial and residential development of the area. The Developer in the City of Antioch will construct the above improvements. The improvements on Empire Avenue are Master Plan Improvements which are part of the City’s Development Fee Program. The City of Brentwood will reimburse costs for installation and construction of a northbound lane and the costs of half of the construction of the center median, including landscape installation. Although Empire Avenue is controlled by the City of Antioch, existing residents and future developments will utilize this roadway for access; therefore, both Cities have concluded that it is in their best interest to cooperatively improve this roadway.

When the properties on the east side of Empire Avenue develop, that developer will be responsible for undergrounding the overhead utilities and completing the roadway improvements.

FISCAL IMPACT
The City’s portion of these improvements is $178,019 and has been budgeted in the Empire Avenue Extension North – Phase l, CIP Project No. 336-3151. This amount is due payable within 30 days upon execution of this agreement per the terms of this agreement.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER TO EXECUTE A REIMBURSEMENT AGREEMENT WITH THE CITY OF ANTIOCH FOR THE EMPIRE AVENUE EXTENSION NORTH – PHASE I, CIP PROJECT NO. 336-3151.
