Subject/Title: Temporary Closure of Concord Avenue from Balfour Road to Fairview Avenue.

RECOMMENDATION
Adopt a Resolution authorizing the City Engineer to temporarily close Concord Avenue from Balfour Road to Fairview Avenue for a period not to exceed five working days, for the State Route 4 Bypass (“Bypass”) Authority to facilitate necessary utility relocations for the Bypass Segment 3 Construction.

BACKGROUND
The State Route 4 Bypass (“Bypass”) Authority is moving forward with advertisement for bid of Segment 3 this winter and starting construction in early 2006. Unfortunately, the East Contra Costa Irrigation District (ECCID) canal is in conflict with the Bypass Segment 3 alignment. This utility must be undergrounded and relocated during the winter months while ECCID is not providing irrigation water to its customers, but conducting routine yearly maintenance. Presently, this work is scheduled to be completed in early 2006, weather permitting. The most feasible and timely approach in order to underground and relocate this ECCID facility, is to close Concord Avenue to open cut the new pipeline starting from the existing ECCID system to the “west” of the Bypass and crossing the Bypass via pipeline and connecting to the ECCID system to the “east” of the Bypass. This closure is the most effective approach to keep the Bypass Segment 3 project on schedule for completion at the end of 2007. During the closure, traffic will be re-routed along the segment of Fairview Avenue between Balfour Road and Concord Avenue. It is critical for the Bypass Authority and the City to keep the Segment 3 on schedule by relocating the ECCID facility project prior to the main Bypass Segment 3 project being awarded and thus avoiding any project delays. Keeping the safety as the foremost priority and to minimize the inconvenience to the commuters and general public, staff concurs with the Bypass Authority to close this portion of Concord Avenue for a maximum of five working days. Closure of the road will expedite the construction process and will minimize the construction time required to complete the ECCID pipeline relocation. The detour plan for these improvements will be reviewed and approved by the City Engineer prior to construction. The City Engineer will have the discretion of determining when to allow the Bypass Authority to proceed with the work and notifying the Police Department, Fire Department, property owners and other impacted agencies of this closure.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY ENGINEER TO TEMPORARILY CLOSE CONCORD AVENUE FROM BALFOUR ROAD TO FAIRVIEW AVENUE FOR A PERIOD NOT TO EXCEED FIVE WORKING DAYS, FOR THE STATE ROUTE 4 BYPASS (“BYPASS”) AUTHORITY TO FACILITATE NECESSARY UTILITY RELOCATIONS FOR THE BYPASS SEGMENT 3 CONSTRUCTION.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby authorize the City Engineer to temporarily close Concord Avenue from Balfour Road to Fairview Avenue for a period not to exceed five working days, for the State Route 4 Bypass (“Bypass”) Authority to facilitate necessary utility relocations for the Bypass Segment 3 Construction.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 13th day of December 2005 by the following vote:
