RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute the following Contract Term Amendments for time extensions and amount amendments for Professional Services Agreements (Exhibit “A” attached) as needed for various project completions: Amendment Four with Bellecci & Associates, Inc. for the Lone Tree Way Widening; Amendment Four with Gray Bowen and Company for the Lone Tree Way Widening; Amendment One with Biggs Cardosa Associates, Inc. for the Communication Tower (Police Station); Amendment One with BKF Engineers for the Sarah Street Water Distribution System Improvements; Amendment One with Control Manufacturing, Inc. for the Water Distribution Telemetry/SCADA; Amendment One with JSP Automation for the Wastewater Treatment Plant; Amendment Two with Kimley Horn & Associates for the Zone 1 Reservoir 1.3; Amendment Two with The Covello Group for the Zone 1 Reservoir 1.3; Amendment Two with Luhdorff & Scalmanini Consulting Engineers for the Water Well #15; Amendment One with Mark Thomas & Company for the Empire Avenue Expansion – North; Amendment One with Milani & Associates for the Grant Street School Infrastructure; Amendment Three with The Covello Group for the Sunset Industrial Complex; Amendment Two with RGM and Associates for the New Police Station, which includes a contract increase of $18,000; Amendment One with Transcomp Systems for the Tower Software Package, which includes a contract increase of $35,000; Amendment One with Sweetser and Associates for the Solid Waste Transfer Station.

PREVIOUS ACTION
City Council authorized staff to execute several contracts for various projects as shown in Exhibit “A”.

BACKGROUND
As a streamlining process, staff reviews various professional service agreements at the end of every year and brings them forward to the City Council for appropriate time extensions. As you may know, several Capital Improvement Projects are in various stages of design and construction. Many of the projects are in the final stage of completion with minor punchlist items to be finished and as-built drawings to be submitted. Staff has prepared a status of projects (Exhibit “A” attached) that identify the phase of each of the projects which require a Contract Amendment to allow for design and or construction completion. Typically, a design professional may start a project during the preliminary design phase and continue through final design and construction phases of the project, until the final as-built drawing stage of the project. The "project process" in California, in dealing with any environmental issues or outer agency issues, increased design and construction time by elevating this work to labor-intensive procedures. These procedures increase the timeframe in which we can expect to complete a design or construction on any given project.

FISCAL IMPACT
Thirteen of the fifteen contract amendments do not have any affect on the fiscal impact of the associated projects. RGM and Associates’ contract amendment includes a change order of $18,000, which will be funded through the New Police Station budget for additional contract close out and on-call warranty services work. This change order brings the total of their contract to $493,000. Transcomp Systems has an increase of $35,000 for additional conversion services, bringing the total of their contract to $83,145. There are funds available in the Solid Waste Operation’s general budget to cover this contract increase.

WHEREAS, on December 14, 2004, the contract term was amended to reflect contract completion of December 31, 2005.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 1, of the Contract, entitled Scope of Services is amended to include additional contract close out and on-call warranty services work.
2. Section 4, of the Contract, entitled Term is amended to change the termination date to project completion.

1. Section 1, of the Contract, entitled Scope of Services is amended to include additional data conversion services.
2. Section 4, of the Contract, entitled Term is amended to change the termination date to project completion.
3. Section 5, of the Contract, entitled Payment is amended to increase the contract amount from $48,125 to $83,125, an increase of $35,000.
4. All other terms remain unchanged.

AMENDMENT ONE TO AGREEMENT FOR PROFESSIONAL SERVICES OF SWEETSER & ASSOCIATES

SOLID WASTE TRANSFER STATION
CIP PROJECT NO. 542-5402

This Amendment is entered into on December 13, 2005 by and between the City of Brentwood and Sweetser & Associates.

WHEREAS, on July 1, 2004, the City of Brentwood entered into a contract with Sweetser & Associates to obtain solid waste permit and compliance services on an as-needed basis for the Solid Waste Transfer Station, CIP Project No. 542-5402 (the Contract).

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 4, of the Contract, entitled Term is amended to change the termination date to project completion.
2. All other terms remain unchanged.
