Subject/Title: Adopt a Resolution Accepting Improvements for Subdivision No. 8661, Braddock and Logan, Stonehaven.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Subdivision No. 8661, Braddock and Logan, Stonehaven, located north of Central Boulevard and east of Fairview Avenue.

PREVIOUS ACTION
On December 17, 2002, by Resolution No. 02-84, Planning Commission approved Tentative Subdivision Map No. 8661, with conditions.

On October 28, 2003, City Council was notified through an informational report of the approval of Final Subdivision Map No. 8661, acceptance of improvement securities and approval of a Subdivision Improvement Agreement.

On February 22, 2005, by Resolution No. 2005-47, City Council approved an Amended Reimbursement Agreement with Braddock and Logan for Master Planned Facility Improvements.

BACKGROUND
This subdivision, located north of Central Boulevard and east of Fairview Avenue, has been developed by Braddock and Logan and contains 45 single-family residential lots. All public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping. As a part of this project, Braddock and Logan completed the widening of Central Boulevard and Fairview Avenue to four (4) full travel lanes with medians and parkway landscaping, as well as upgrading the traffic signal to serve the improved intersection. Braddock and Logan have provided Maintenance Bonds to cover the twelve-month warranty period for all improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 1,510 LF of 8” sewer lines, 1,090 LF of 8” waterlines, 770 LF of 12” waterlines, 55,950 LF of various diameter storm drain, 5,492 LF of 5’ wide sidewalk, 2,711 LF of pavement, 5,325 LF of curb and gutter, 17 streetlights, 4,005 LF of fiber optic conduit and 45,085 SF of landscaping and irrigation.

When the Final Map was approved by the City Manager, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements, the City will incur annual costs in the amount of approximately $36,000 associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 02-13 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR STONEHAVEN, BRADDOCK AND LOGAN SUBDIVISION NO. 8661, LOCATED NORTH OF CENTRAL BOULEVARD AND EAST OF FAIRVIEW AVENUE.

WHEREAS, on December 17, 2002, by Resolution No. 02-84, Planning Commission approved Tentative Subdivision Map No. 8661 with conditions; and

WHEREAS, on October 28, 2003, City Council was notified through an informational report of the approval of Final Subdivision Map No. 8661, acceptance of improvement securities and approval of a Subdivision Improvement Agreement; and

WHEREAS, on February 22, 2005, by Resolution No. 2005-47, City Council approved an Amended Reimbursement Agreement with Braddock and Logan for Master Planned Facility Improvements; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for Subdivision No. 8661, Braddock and Logan, Stonehaven, for maintenance; and

1. All offers of dedication for rights-of-way, easements, abutter’s rights, sub-surface mineral and water rights and parcels of land intended for public use as shown on the final map are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
