Adopt a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the final map; accepting all public improvements for
maintenance; accepting the Subdivision Maintenance Bond and releasing the
Subdivision Improvement Securities for Subdivision No. 8659, Brookfield
Homes, Shadow Lakes Unit 10, located north of Balfour Road and west of
On March 9, 1993, by Resolution No. 93-27, Planning Commission of the City
of Brentwood, approved Tentative Subdivision Map No. 7705 with conditions.
On February 10, 2004, City Council was notified through an informational
report of the approval of Final Subdivision Map No. 8659, acceptance of
improvement securities and approval of a Subdivision Improvement Agreement.
This Final Map, located north of Balfour Road and west of Roundhill Drive,
has been developed as part of the Shadow Lakes development by Brookfield
Homes and contains 32 single-family residential lots. All public
improvements required by the project’s Conditions of Approval have been
constructed and inspected for conformance with the approved improvement
plans including sewer, water and storm drain lines, sidewalk, paving,
streetlights, fiber optic conduit and landscaping. Brookfield Homes has
provided a Maintenance Bond to cover the twelve-month warranty period for
all improvements. A final inspection of these improvements has found them to
be complete and ready for acceptance by the City for maintenance.
As required by the conditions of approval and shown on the improvement
plans, the Developer has installed the following improvement quantities:
1,681 LF of 8” sewer lines, 1,755 LF of 8” waterlines, 242 LF of 12”
waterlines, 1,913 LF of 18” storm drain, 2,580 LF of 5’ wide sidewalk, 1,842
LF of pavement, 3,512 LF of curb and gutter, 20 streetlights, 1,760 LF of
fiber optic conduit and 8,400 SF of landscaping.
When the Final Map was approved by the City Manager, the right-of-way offers
of dedication were accepted subject to acceptance of improvements. The
improvements are now installed to support the new lots; therefore, it is the
appropriate time to accept the improvements, rights-of-way and easements as
offered on the Final Map.
Upon acceptance of improvements the City will incur annual costs in the
amount of approximately $13,300 associated with necessary maintenance of
streets, landscaping and utilities. Routine roadway maintenance will be
funded by the General Fund and Measure “C” gas tax, with sewer and water
maintenance funded through their respective enterprise funds. Landscaping
and Lighting Assessment District (LLD) No. 97-1 has been formed for this
subdivision and will be responsible for the street lighting and landscape

OF BALFOUR ROAD AND WEST OF ROUNDHILL DRIVE.
WHEREAS, on March 9, 1993, by Resolution No. 93-27, Planning Commission of
the City of Brentwood, approved Tentative Subdivision Map No. 7705 with
WHEREAS, on February 10, 2004, City Council was notified through an
informational report of the approval of Final Subdivision Map No. 8659,
acceptance of improvement securities and approval of a Subdivision
Improvement Agreement; and
WHEREAS, the required public improvements have been completed and
constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
that the public improvements are hereby accepted for Subdivision No. 8659,
Brookfield Homes, Shadow Lakes Unit 10, for maintenance; and
1. All offers of dedication for rights-of-way, easements, abutter’s rights,
sub-surface mineral and water rights and parcels of land intended for public
use as shown on the final map are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and
workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within
sixty (60) days of the passage of this Resolution.
4. The City Council of the City of Brentwood directs the City Clerk to file
this Resolution with the Recorder of Contra Costa County.
