Subject/Title: Adopt a Resolution Accepting Improvements for Subdivision No. 8210, Brookfield Homes, Shadow Lakes Unit 4.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the final map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Subdivision No. 8210, Brookfield Homes, Shadow Lakes Unit 4, located north of Balfour Road and east of Roundhill Drive.

PREVIOUS ACTION
On March 9, 1993, by Resolution No. 93-27, Planning Commission of the City of Brentwood, approved Tentative Subdivision Map No. 7705 with conditions.

On August 28, 2001, by Resolution No. 2350, City Council approved Final Subdivision Map No. 8210, accepting improvement securities and approving a Subdivision Improvement Agreement.

BACKGROUND
This Final Map, located north of Balfour Road and east of Roundhill Drive, has been developed as part of the Shadow Lakes development by Brookfield Homes and contains 68 single-family residential lots. All public improvements required by the project’s Conditions of Approval have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping. Brookfield Homes has provided a Maintenance Bond to cover the twelve-month warranty period for all improvements. A final inspection of these improvements has found them to be complete and ready for acceptance by the City for maintenance.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 4,936 LF of 8” sewer lines, 3,285 LF of 8” waterlines, 1,354 LF of 16” waterlines, 5,858 LF of various diameter storm drain, 8,079 LF of 5’ wide sidewalk, 8,089 LF of pavement, 9,520 LF of curb and gutter, 31 streetlights, 4,760 LF of fiber optic conduit and 8,900 SF of landscaping.

When the Final Map was approved by City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements, the City will incur annual costs in the amount of approximately $39,000 associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 97-1 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SHADOW LAKES UNIT 4, BROOKFIELD HOMES SUBDIVISION NO. 8210, LOCATED NORTH OF BALFOUR ROAD AND EAST OF ROUNDHILL DRIVE.

WHEREAS, on March 9, 1993, by Resolution No. 93-27, Planning Commission of the City of Brentwood, approved Tentative Subdivision Map No. 7705 with conditions; and

WHEREAS, on August 28, 2001, by Resolution No. 2350, City Council approved Final Subdivision Map No. 8210, accepting improvement securities and approving a Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for Subdivision No. 8210, Brookfield Homes, Shadow Lakes Unit 4, for maintenance; and

1. All offers of dedication for rights-of-way, easements, abutter’s rights, sub-surface mineral and water rights and parcels of land intended for public use as shown on the final map are hereby accepted.
2. The Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
