Subject/Title: Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Purchase Agreement and a Grant of Easement with the Housing Authority of the County of Contra Costa for the Walnut Boulevard Widening, CIP Project No. 336-3056.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager or her designee to execute a Purchase Agreement and a Grant of Easement and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, with the Housing Authority of the County of Contra Costa, for a portion of real property identified as APN 012-142-017, generally located at the southwest corner of McClarren Road and Walnut Boulevard.

PREVIOUS ACTION
On May 26, 1998, City Council approved an updated Master Agreement, Administering Agency-State Agreement for Federal Aid Projects No. 04-5300.

On June 27, 2000, City Council authorized the City Manager to sign a design contract with Harris & Associates for the design of Walnut Boulevard Widening, CIP Project No. 336-3056, from Balfour Road to Oak Street.

On March 13, 2001, by Resolution No. 2249, City Council authorized the City Manager to execute a Program Supplement Agreement No. 002-M to Administering Agency-State Agreement No. 04-5300 for reimbursement of costs for preliminary engineering for the Walnut Boulevard Widening, CIP Project No. 336-3056.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the 2005/06 – 2009/10 Capital Improvement Program (CIP) that included the Walnut Boulevard Widening, CIP Project No. 336-3056.

BACKGROUND
Walnut Boulevard is our main gateway to the City from the south and carries the majority of commute traffic from East County to Tri-Valley and Silicon Valley for jobs. Also, Walnut Boulevard is one of the main corridors to the downtown area, as well as to the Liberty High School. The widening of Walnut Boulevard will improve the northbound and southbound vehicular commute traffic to the City’s main commute arterial. This project will also upgrade the storm drain, water and sewer systems in that vicinity. The project consists of 2,300 linear feet of widened street and asphalt concrete overlay, installation of curbs, gutters and sidewalk, plus installation of 2,300 linear feet of storm drain, sewer, water and fiber optic conduit systems. Also, construction of this project will induce development of properties between Walnut Boulevard and the Union Pacific Railroad, south of Oak Street.

The City was awarded a grant in the amount of $1,300,000 from the Federal Intermodal Surface Transportation Efficiency Act (ISTEA) program, but due to time constraints it was impossible to meet Federal requirements. The Metropolitan Transportation Commission (MTC) approved the City’s request to transfer $1,110,000 of these funds to the Brentwood Boulevard Widening, CIP Project No. 336-3054. The City is obligated, per signed agreement with the State of California, to perform this work prior to September 2007.

The acquisition of a portion of the Housing Authority property is essentially the last acquisition required to move forward with the right-of-way certification process that will allow the City to go out to bid early 2006. This easement is necessary to construct this project to its ultimate improvements.

FISCAL IMPACT
The acquisition costs of $19,843 have been budgeted through the Walnut Boulevard Widening, CIP Project No. 336-3056. The future annual Operating/Maintenance Cost has been estimated at $9,476 a year and will be funded by a combination of Measure “C”, gas tax and Enterprise Funds.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE A PURCHASE AGREEMENT AND A GRANT OF EASEMENT AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY, WITH THE HOUSING AUTHORITY OF THE COUNTY OF CONTRA COSTA, FOR A PORTION OF REAL PROPERTY IDENTIFIED AS APN 012-142-017, GENERALLY LOCATED AT THE SOUTHWEST CORNER OF MCCLARREN ROAD AND WALNUT BOULEVARD.

WHEREAS, real property generally located at the southwest corner of McClarren Road and Walnut Boulevard in the City of Brentwood, identified as APN 012-142-017, is needed for the Walnut Boulevard Widening, CIP Project No. 336-3056; and

WHEREAS, a purchase agreement between the City of Brentwood and the vested property owner has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Brentwood does hereby approve and authorize the City Manager or her designee to execute a Purchase Agreement and a Grant of Easement and such other documents as may be needed to complete the transaction, hereby accepting real property on behalf of the City, with the Housing Authority of the County of Contra Costa, for a portion of real property identified as APN 012-142-017, generally located at the southwest corner of McClarren Road and Walnut Boulevard.
