Subject/Title: Adopt a Resolution accepting the work performed at the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Marina Mechanical, Metal Building Company, D&D Commercial Painting, Inc., Del Monte Electric Company, Inc. and Legg, Inc. for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709 and direct the City Clerk to file the Notices of Completion with the County Recorder.

PREVIOUS ACTION
On September 14, 2004, by Resolution No. 2004-213, City Council approved the contract documents and awarded the construction contracts for the New Police Station (Group B), CIP Project No. 337-3142 and the New City Hall, CIP Project No. 337-3139, to the following contractors: Pro-Fit Fire Services, for Bid Package #4 – Fire Sprinklers in the amount of $112,600 plus a 10% contingency and Marina Mechanical for Bid Package #6 – Mechanical HVAC in the amount of $632,800, plus a 10% contingency.

On November 9, 2004, by Resolution No. 2004-253, City Council approved the contract documents and awarded the construction contracts for the New Police Station (Group C), CIP Project No. 337-3142, with exception of Bid Packages #15 and #16 (which were re-bid), totaling $3,654,974.85.

On February 8, 2005, by Resolution No. 2005-27, City Council approved the creation of the City Data Center, CIP Project No. 337-3709, to separate the work from the New City Hall Project and the New Police Station Project.

On September 27, 2005, by Resolution No. 2005-231, City Council accepted the work performed by Dean’s Acoustical Ceiling, Denham Contracting and Systems & Space for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709 and directed the City Clerk to file the Notices of Completion with the County Recorder.

On October 25, 2005, by Resolution No. 2005-258, City Council accepted the work performed by Pueblo Tile, BT Mancini, Concord Iron Works, Martinez Sheet Metal, Melloni Construction (Package #18 Casework), Pro-Fit Fire Services and Freas Plastering for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709 and directed the City Clerk to file the Notices of Completion with the County Recorder.

BACKGROUND
This New Police Facility project is a multi prime project which requires several trades to work within the specified site, all by separate contracts managed by staff as discussed with the task force during the project budgeting process. The attached Notices of Completion (NOC’s) reflect work completed by five of the trades per contractual obligations for this project. Marina Mechanical completed the mechanical HVAC, Metal Building Company completed the metal buildings and installed the overhead doors, D&D Commercial Painting, Inc., completed the painting, Del Monte Electrical Company, Inc., completed all the electrical work and Legg, Inc., provided and installed the detention equipment for the New Police Station. As a multi prime project, the work is completed in phases and staff recommends accepting the work performed by the trades as indicated in the attached NOC’s.

FISCAL IMPACT
Total contract amounts for the New Police Facility and City Data Center combined are as follows:

Marina Mechanical $ 691,185.96
Metal Building Company $ 231,331.36
D&D Commercial Painting, Inc. $ 89,226.93
Del Monte Electric Company, Inc. $1,656,609.89
Legg, Inc. $ 167,907.93

The work is complete and is 3.8% under City Council approved amounts for these improvements.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY MARINA MECHANICAL, METAL BUILDING COMPANY, D&D COMMERCIAL PAINTING, INC., DEL MONTE ELECTRIC COMPANY, INC., AND LEGG, INC. FOR THE NEW POLICE FACILITY, CIP PROJECT NO. 337-3142 AND CITY DATA CENTER, CIP PROJECT NO. 337-3709 AND DIRECT THE CITY CLERK TO FILE THE NOTICES OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the worked performed by Marina Mechanical, Metal Building Company, D&D Commercial Painting Inc., Del Monte Electric Company Inc., and Legg, Inc., for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709, as indicated on the Notices of Completion documents, is hereby accepted and the City Clerk is hereby directed to file the Notices of Completion with the County Recorder for this project.
