Subject/Title: Adopt a Resolution approving and authorizing the City Manager to execute Amendment One to the Professional Services Agreement with Parsons Brinckerhoff Construction Services, Inc. for construction inspection and other related services in an amount not to exceed $105,000.

RECOMMENDATION
Adopt a Resolution approving and authorizing the City Manager to execute Amendment One to the Professional Services Agreement with Parsons Brinckerhoff Construction Services, Inc. for construction inspection and other related services for the City of Brentwood Engineering Department on an as-needed basis in an amount not to exceed $105,000.

PREVIOUS ACTION
A previous Professional Services Agreement for Construction Inspection Services had been executed with Parsons Brinckerhoff Construction Services, Inc. in the amount of $40,000.

BACKGROUND
With the continuing fast pace of infrastructure improvements and new subdivision/commercial development in the City, it is of utmost importance to have appropriate inspections performed to achieve a good quality product. The Construction Inspection Division within the Engineering Department lost one inspection personnel in September 2005 and is in the process of filling that vacant position. Due to this lack of personnel to adequately handle construction inspection for general engineering projects and other related services, Parsons Brinckerhoff Construction Services, Inc. entered into a Professional Services Agreement with the City of Brentwood on September 21, 2005. The original agreement was for the maximum amount of $40,000. At this time, the Engineering Department is still without the proper personnel in the Construction Inspection Division and Parsons Brinckerhoff Construction Services, Inc.’s assistance will be required until the City fills the vacant Construction Inspector position. This contract amendment will bring the cost of these services over the $50,000 limit, which per the City’s Purchasing Policy, requires City Council approval.

Staff has been very satisfied with Parsons Brinckerhoff Construction Services, Inc.’s present and previous professional work performance; therefore, staff recommends that the City Council amend and approve Amendment One to the Professional Services Contract with Parsons Brinckerhoff Construction Services, Inc. to perform various Construction Inspection Services on an as-needed basis.

FISCAL IMPACT
The original purchase order of $40,000 was executed by the City Manager as authorized by the City’s Purchasing Policy. The continuing additional services require this amendment to be approved by the City Council. The funds for this amendment, in the amount of $105,000 to pay for the continuing services of Parsons Brinckerhoff Construction Services, Inc., along with the original purchase order in the amount of $40,000 have been budgeted in the 2005/06 – 2006/07 Final Operating Budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT ONE TO THE PROFESSIONAL SERVICES AGREEMENT WITH PARSONS BRINCKERHOFF CONSTRUCTION SERVICES, INC. FOR CONSTRUCTION INSPECTION AND OTHER RELATED SERVICES FOR THE CITY OF BRENTWOOD ENGINEERING DEPARTMENT ON AN AS-NEEDED BASIS IN AN AMOUNT NOT TO EXCEED $105,000.

WHEREAS, due to lack of personnel in the Construction Inspection Division within the Engineering Department to adequately handle construction inspection for general engineering projects and other related services, Parsons Brinckerhoff Construction Services, Inc. entered into a Professional Services Agreement with the City of Brentwood on September 21, 2005; and

WHEREAS, the original Professional Services Agreement was for the maximum amount of $40,000; and

WHEREAS, the Engineering Department is still without the proper personnel in the Construction Inspection Division and Parsons Brinckerhoff Construction Services, Inc.’s assistance will be required until we are able to fill the vacant Construction Inspector position; and

WHEREAS, staff has been very satisfied with Parsons Brinckerhoff Construction Services, Inc.’s present and previous professional work perfomance.

NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve and authorize the City Manager to execute Amendment One to the Professional Services Agreement with Parsons Brinckerhoff Construction Services, Inc. for construction inspection and other related services for the City of Brentwood Engineering Department on an as-needed basis in an amount not to exceed $105,000.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 8th day of November 2005 by the following vote:

AMENDMENT ONE
TO AGREEMENT FOR PROFESSIONAL SERVICES
OF PARSONS BRINCKERHOFF CONSTRUCTION SERVICES, INC.

This Amendment is entered into on November 8, 2005, by and between the City of Brentwood and Parsons Brinckerhoff Construction Services, Inc.

WHEREAS, on the 21st day of September 2005, the City of Brentwood entered into a contract with Parsons Brinckerhoff Construction Services, Inc., to obtain construction inspection services for general engineering projects on an as-needed basis.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 6, of the original contract, entitled Payment is amended to change the maximum contract amount from $40,000 to $145,000, reflecting an increase of $105,000.
2. All other terms remain unchanged.
