Subject/Title: Adopt a Resolution approving a change order in an amount not to exceed $35,000 for Wastequip McLaughlin and authorizing the City Manager or her designee to execute the change order.

RECOMMENDATION
Adopt a Resolution approving a change order in an amount not to exceed $35,000 for Wastequip McLaughlin and authorizing the City Manager or her designee to execute the change order.

PREVIOUS ACTION
On February 24, 2004, by Resolution No. 2004-40, City Council adopted Purchasing Policy 10-7.

On June 14, 2005, by Resolution No. 2005-143, City Council adopted the 2005/06 – 2006/07 Operating Budget for the City of Brentwood.

On July 12, 2005, by Resolution No. 2005-172, City Council approved a purchase order in the amount of $75,000 for Wastequip/McLaughlin.

BACKGROUND
A purchase order for Wastequip McLaughlin in the amount of $75,000 was issued in August of 2005. Staff has currently spent $56,823.99 on this purchase order.

The Solid Waste Division plans to utilize the remaining $18,176.01 for the purchase of additional containers. Staff projects it will need additional funds to accommodate the rapid growth in the commercial front-load and roll-off debris box units of their division.

Staff is requesting that a change order be issued in the amount of $35,000 to accommodate the purchase of these steel containers for the new commercial units.

Staff solicited bids in June of 2004. Wastequip McLaughlin provided the best pricing and currently offers the same pricing from this bid.

This purchase is in compliance with Purchasing Policy 10-7.

FISCAL IMPACT
The change order in the amount of $35,000 will bring the total purchase order amount to $110,000. These funds were budgeted in the 2005/06 Fiscal Year and will be expended through the Solid Waste Enterprise Fund.

Wastequip McLaughlin has stated this current bid will hold for one more order; therefore, we will go out to bid soon after the next order is placed. There is a potential that if they receive the bid and if we have the need for additional purchases beyond this change order we may come back to Council for a further change order.

RESOLUTION NO.

ADOPT A RESOLUTION APPROVING A CHANGE ORDER IN AN AMOUNT NOT TO EXCEED $35,000 FOR WASTEQUIP MCLAUGHLIN AND AUTHORIZING THE CITY MANAGER OR HER DESIGNEE TO EXECUTE THE CHANGE ORDER.

WHEREAS, on February 24, 2004, by Resolution No. 2004-40, City Council adopted Purchasing Policy 10-7; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the change order with Wastequip McLaughlin in an amount not to exceed $35,000 for a total purchase order amount of $110,000 is approved and the City Manager or her designee is authorized to execute the change order.
