REDEVELOPMENT AGENCY AGENDA ITEM NO. 4

Subject/Title: Adopt a Resolution authorizing the Executive Director or her designee to accept a Grant Deed transferring ownership of the property located at 9100 Brentwood Boulevard (APN 010-160-015) from the City to the Brentwood Redevelopment Agency.

RECOMMENDATION
Adopt a Resolution authorizing the Executive Director or his/her designee to accept a Grant Deed hereby conveying real property generally identified as APN 010-160-015 located at 9100 Brentwood Boulevard, from the City and execute any other documents as may be needed to complete the transfer.

PREVIOUS ACTION
On September 17, 2003, by Resolution No. 2980, the City Council approved authorization for the City Manager to execute a purchase agreement for 9100 Brentwood Boulevard, APN 010-160-015.

BACKGROUND
For the purpose of cooperating in the planning, undertaking, or operation of redevelopment projects located within a redevelopment project area, Community Redevelopment Law, Health & Safety Code Section 33220, authorizes cities to dedicate, sell or convey any of its property to a redevelopment agency. Redevelopment agencies have the legal authority to actively participate in a lease and/or sale of property for economic development purposes. The property located at 9100 Brentwood Boulevard is located within the Brentwood (“Downtown”) Redevelopment Project Area.

Transfer of 9100 Brentwood Boulevard from City ownership to Agency ownership will better facilitate the lease and/or sale of a 20,000 square foot building and parking area located on the eastern portion of 9100 Brentwood Boulevard. Redevelopment staff anticipates entering into a lease agreement with Precision Cabinets, located on Middlefield Court in the Harvest Business Park, for the expansion of their business. Precision Cabinets employs nearly 300 workers with a large percentage living in Brentwood. Of the nearly 300 jobs, approximately 30 percent are front office administrative, technical and sales jobs. Precision is also a significant business contributor to the City’s sales tax revenue. The lease agreement, and its terms and conditions, will be returned to the Agency at a later date for consideration and approval.

Staff will immediately begin work to record a minor subdivision map that will separate 9100 Brentwood Boulevard into two or three parcels. This will allow the western portion of the property, where the Police Facility is located, to be re-conveyed back to the City from the Agency in a few months.

Property management duties and functions will be performed by the Facilities Maintenance Division of the Parks & Recreation Department.

FISCAL IMPACT
The Agency will fund legal costs associated with preparation of the lease documents, as well as the civil engineering, city fees and recording costs associated with the minor subdivision map. If the option to purchase is exercised, the Agency will fund the commission of the land appraisal and legal costs to prepare the sale agreement.

At this time, no funds shall be paid by the Agency to the City for 9100 Brentwood Boulevard. The future lease and/or sale proceeds will be shared between the City and Agency in proportions that will reimburse the Agency for its direct and indirect expenses, including staff time and administrative overhead based on the 2005/06 Cost Allocation Plan.

A RESOLUTION OF THE REDEVELOPMENT AGENCY OF THE CITY OF BRENTWOOD AUTHORIZING THE EXECUTIVE DIRECTOR OR HER DESIGNEE TO ACCEPT A GRANT DEED HEREBY CONVEYING REAL PROPERTY GENERALLY IDENTIFIED AS APN 010-160-015 LOCATED AT 9100 BRENTWOOD BOULEVARD, FROM THE CITY OF BRENTWOOD AND TO EXECUTE ANY OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSFER.

WHEREAS, On September 17, 2003, by Resolution No. 2980, the City Council of the City of Brentwood approved authorization for the City Manager to execute a purchase agreement for 9100 Brentwood Boulevard, APN #010-160-015; and

WHEREAS, Community Redevelopment Law, Health & Safety Code Section 33220 authorizes cities to dedicate, sell or convey any of its property to a redevelopment agency for the purpose of cooperating in the planning, undertaking, or operation of redevelopment projects located within a redevelopment project area; and

WHEREAS, 9100 Brentwood Boulevard is located within the Merged Redevelopment Project Areas; and

WHEREAS, transfer to the Agency is necessary to facilitate and participate in economic development activities for job retention and creation, increased property taxes, generation of sales tax revenues, and encouragement of private investment within the Merged Redevelopment Project Areas; and

WHEREAS, a Grant Deed must be accepted and recorded to transfer ownership to the Redevelopment Agency of the City of Brentwood.

NOW, THEREFORE BE IT RESOLVED that the Redevelopment Agency of the City of Brentwood authorizes the Executive Director or her designee to accept a Grant Deed hereby conveying real property generally identified as APN 010-160-015 located at 9100 Brentwood Boulevard, from the City of Brentwood and to execute any other documents as may be needed to complete the transfer.
