Subject/Title: Adopt a Resolution accepting the work performed at the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Pueblo Tile, BT Mancini, Concord Iron Works, Martinez Sheet Metal, Melloni Construction (Package #18 Casework), Pro-Fit Fire Services and Freas Plastering for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709 and direct the City Clerk to file the Notices of Completion with the County Recorder.

PREVIOUS ACTION
On February 10, 2004, by Resolution No. 2004-27, City Council authorized staff to execute an agreement for design services for the New Police Station with Kaplan McLaughlin Diaz (KMD) in an amount not to exceed $673,363 and amended the 2003/04 – 2007/2008 Capital Improvement Program Budget Sheet.

On July 13, 2004, by Resolution No. 2004-176, City Council approved the contract documents and awarded the construction contract for the New Police Station (Group A - Seismic Retrofit) to Concord Iron Works, Inc., in an amount not to exceed $698,450 for CIP Project No. 337-3142 and further authorized the City Manager to execute change orders within a 10% contingency for a total authorized amount of $768,295.

On September 14, 2004, by Resolution No. 2004-213, City Council approved the contract documents and awarded the construction contracts for the New Police Station (Group B), CIP Project No. 337-3142 and the New City Hall, CIP Project No. 337-3139, to the following contractors: Pro-Fit Fire Services, for Bid Package #4 – Fire Sprinklers in the amount of $112,600 plus a 10% contingency and Marina Mechanical for Bid Package #6 – Mechanical HVAC in the amount of $632,800, plus a 10% contingency.

On September 28, 2004, by Resolution No. 2004-225, City Council approved the contract documents and awarded the construction contract for the New Police Station (Group B) Bid Package #5 - Plumbing, CIP Project No. 337-3142 to Martinez Sheet Metal, Inc., in the amount of $217,715, plus a 10% contingency.

On November 9, 2004, by Resolution No. 2004-253, City Council approved the contract documents and awarded the construction contracts for the New Police Station (Group C), CIP Project No. 337-3142, with exception of Bid Packages #15 and #16 (which were re-bid), totaling $3,654,974.85.

On February 8, 2005, by Resolution No. 2005-27, City Council approved the creation of the City Data Center, CIP Project No. 337-3709, to separate the work from the New City Hall Project and the New Police Station Project.

On February 22, 2005, by Resolution No. 2005-43, City Council approved the contract documents and awarded the construction contract to BT Mancini Co., Inc. for the New Police Station (Group C-Rebid), CIP Project No. 337-3142 and the City Data Center, CIP Project No. 337-3709 in the amount of $99,960, plus a 10% contingency, for Bid Package #15 – Flooring and authorizing the City Manager to execute the construction contract and related documents.

On September 27, 2005, by Resolution No. 2005-231, City Council accepted the work performed by Dean’s Acoustical Ceiling, Denham Contracting and Systems & Space for the New Police Facility, CIP Project No. 337-3142 and City Data Center, CIP Project No. 337-3709 and directed the City Clerk to file the Notices of Completion with the County Recorder.

BACKGROUND
This project is a multi prime project which requires several trades to work within the specified site, all by separate contracts managed by staff as discussed with the task force during the project budgeting process. One of these contractors, Pueblo Tile who performed the ceramic tile work, was bid through the informal bid process and was awarded their contract on April 14, 2005. The attached Notices of Completion (NOC’s) reflect work completed by seven of the trades for this project. Pueblo Tile completed the ceramic tile work, BT Mancini completed the flooring work, Concord Iron Works completed the structural steel work, Martinez Sheet Metal completed the plumbing work, Melloni Construction (Package #18) completed the casework, Pro-Fit Fire Services installed fire sprinklers and Freas Plastering completed the lath and plastering work for the New Police Station. As a multi prime project, the work is completed in phases and staff recommends accepting the work performed by the trades as indicated in the attached NOC’s.

FISCAL IMPACT
Total contract amounts for the New Police Facility and City Data Center combined are as follows:

The work is complete and is 3.25% under budget for these improvements.
