Subject/Title: Approval of a resolution providing supplemental military pay and continuation of health benefits for up to twelve (12) months for regular employees called to active military duty

RECOMMENDATION
Approve a Resolution to provide supplemental salary and benefits for up to one year for regular employees called to active military duty. These supplemental benefits will alleviate financial hardships that employees and their families experience when an employee is called to active duty.

BACKGROUND
Normally, the City provides military leave benefits as required by State and Federal law. These benefits include full salary and benefits for the first 30 days of their military service each fiscal year. After the initial 30 days of military service there is no State or Federal requirement to continue pay or benefits.

At this time, staff has received notice from one regular employee of his call to active duty for approximately one year for service in Iraq. Without the supplemental salary and benefits, the employee will lose approximately 23% of his salary and would be out-of-pocket an estimated $13,270 in premium payments for health, dental and vision benefits thus causing hardship to his family while he is serving in Iraq.

FISCAL IMPACT
The fiscal impact of the current employee called to active duty equals approximately $33,200. These funds are available in the approved 2005/06 and 2006/07 Operating Budget. Additional staffing costs to back-fill with temporary staff during this employee’s absence will be presented for City Council consideration and approval through the mid-year budget process. Future costs will vary depending on the number of staff that may be on leave at any given time.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO SUPPLEMENT MILITARY PAY AND CONTINUE HEALTH INSURANCE FOR UP TO TWELVE (12) MONTHS FOR EMPLOYEES CALLED TO ACTIVE MILITARY DUTY

WHEREAS, the City Council of the City of Brentwood recognizes the sacrifice and value of City employees that serve as Reservists in the various branches of the military; and

WHEREAS, at this time, the City has identified one (1) regular City employee who is currently a Reservist and has been called into active duty to commence on November 30, 2005; and

WHEREAS, to recognize these City employees who are called to active military duty the City Council desires to alleviate financial hardships that employees and their families will experience as a result of the employee being ordered to active military service; and

WHEREAS, the City’s regular military pay policy complies with State and Federal laws in that it provides paid military leave to a maximum of thirty calendar days per fiscal year to employees who have been with the City for at least one year and who are ordered to active military service; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood:

1. The City will pay the difference between an employee’s base City salary and the employee’s military pay including all military allowances and/or premiums (if the base City salary exceeds the military pay); and
2. The City will pay the same contribution towards an employee’s health, dental, vision, and employee assistance program premiums for an employee called into active duty that it was paying at the time the employee was called up, excluding the cash allowance that may be received in-lieu of health benefits coverage; and
3. The City will continue the pay and benefits for employees remaining in active duty and called into such duty as outlined in this Resolution for up to twelve (12) months from the date that the employee has exhausted the 30 calendar days of pay provided per California Military and Veteran’s Code Section 395.03.
