Subject/Title: Adopt a Resolution approving a Contract Amendment with Teichert Construction for the construction of the additional joint trench infrastructure and IPARQ Way at Sunset Industrial Complex, CIP Project No. 336-3128, in an amount of $524,982.03, plus a 10% contingency and authorizing the City Manager to execute said Amendment and related change order documents.

RECOMMENDATION
Adopt a Resolution approving a Contract Amendment with Teichert Construction for the construction of the additional joint trench infrastructure and IPARQ Way at Sunset Industrial Complex, CIP Project No. 336-3128, in an amount of $524,982.03, plus a 10% contingency of $52,498.20 for a total amount of $577,480.23, and authorizing the City Manager to execute said Amendment and related change order documents.

PREVIOUS ACTION
On July 23, 2002, by Resolution No. 2620, City Council awarded the construction contract for the Sunset Industrial Complex, CIP Project No. 336-3128, to Teichert Construction.

On October 28, 2003, City Council approved the Sunset Industrial Complex Sales Strategy Criteria Ranking and Preliminary Lot Layout, which included the cul-de-sac site plan.

On November 25, 2003, by Resolution No. 3027, City Council authorized the City Manager to execute change orders for installation of cul-de-sacs, a traffic signal and construction management services with The Covello Group and Teichert Construction for the Sunset Industrial Complex, CIP Project No. 336-3128.

On November 25, 2003, by Resolution No. 3028, City Council amended the Reimbursement Agreement between the Brentwood Redevelopment Agency and the City of Brentwood to fund construction of cul-de-sac improvements and traffic signal improvements for the Sunset Industrial Complex, CIP Project No. 336-3128.

On December 14, 2004, by Resolution No. 2004-269, City Council approved a contract with Pacific Gas & Electric for installation of expanded gas and electric service at Sunset Industrial Complex.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program, which included the Sunset Industrial Complex, CIP Project No. 336-3128.

BACKGROUND
The joint trench infrastructure for Sunset Industrial Complex was originally designed to support nine (9) parcels. At the time the layout of Sunset Industrial Complex was changed to include two (2) cul-de-sacs and a total of 19 parcels, 95% of the original improvements had been completed. The joint trench backbone infrastructure was not designed to support all 19 parcels; therefore, it was necessary for the joint trench to be redesigned to accommodate the modified lot layout. PG&E completed the design of the expanded gas and electric service at Sunset Industrial Complex.

In addition to the joint trench work, a new road needs to be installed to accommodate access to the lot north of Elkins Way. The existing pavement currently serves as an access driveway for the City of Brentwood’s Corporation Yard. This driveway will be reconstructed to meet City Standard for a public roadway. This work also involves moving the existing gas meter located at the entrance to the City Corporation Yard.

Teichert Construction submitted a proposal for the change order work for the construction of the additional joint trench backbone infrastructure, IPARQ Way and work related to the installation of these facilities, including the gas meter location on IPARQ Way. St. Francis Electric will be the joint trench subcontractor for Teichert Construction.

FISCAL IMPACT
The total cost for this change order is $524,982.03, plus a 10% contingency in the amount of $52,498.20, for a total amount of $577,480.23, which has been included in the approved 2005/06 – 2009/10 Capital Improvement Program Budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A CONTRACT AMENDMENT WITH TEICHERT CONSTRUCTION FOR THE CONSTRUCTION OF THE ADDITIONAL JOINT TRENCH INFRASTRUCTURE AND IPARQ WAY AT SUNSET INDUSTRIAL COMPLEX, CIP PROJECT NO. 336-3128, IN AN AMOUNT OF $524,982.03, PLUS A 10% CONTINGENCY OF $52,498.20 FOR A TOTAL AMOUNT OF $577,480.23, AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AMENDMENT AND RELATED CHANGE ORDER DOCUMENTS.

Approve a Contract Amendment with Teichert Construction for the construction of the additional joint trench infrastructure and IPARQ Way at Sunset Industrial Complex, CIP Project No. 336-3128, in an amount of $524,982.03, plus a 10% contingency of $52,498.20, for a total amount of $577,480.23; and
2. Authorize the City Manager to execute the Contract Amendment and related change order documents.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 11th day of October 2005 by the following vote:

AMENDMENT ONE
TO
AGREEMENT

This Amendment is entered into on October 11, 2005 by and between the City of Brentwood and Teichert Construction.

WHEREAS, on the 23rd day of July 2002, by Resolution No. 2620, City Council awarded a construction contract with Teichert Construction for the Sunset Industrial Complex, CIP Project No. 336-3128.

WHEREAS, on the 25th day of November 2003, by Resolution No. 3027, City Council authorized the City Manager to execute a change order with Teichert Construction for the installation of cul-de-sacs for the Sunset Industrial Complex, CIP Project No. 336-3128.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 1, of the original contract, entitled Contract Sum is amended to increase the contract total by $524,982.03, bringing the new contract total to $4,270,198.55.
2. All other terms remain unchanged.
