CITY COUNCIL AGENDA ITEM NO. 4

Meeting Date: October 11, 2005

Subject/Title: Adopt a Resolution approving Grant Deeds to the State of California (Caltrans) for roadway along Highway 4 (Brentwood Boulevard) required as part of the Brentwood Boulevard Widening, CIP Project No. 336-3054 and authorizing execution of said Grant Deeds.

RECOMMENDATION
Adopt a Resolution approving Grant Deeds to the State of California and authorizing the City Manager or any of her designees to execute said Grant Deeds, hereby conveying real property to the State of California (Caltrans), identified as a portion of roadway parallel to Highway 4 (Brentwood Boulevard) on the east side and west side, generally located between Village Drive and Applewood Common and any other documents necessary to complete the transaction.

PREVIOUS ACTION
On May 26, 1998, the City of Brentwood approved an updated Master Agreement between the City of Brentwood and the State of California Federal Aid Projects 04-5300.

On May 8, 2001, by Resolution No. 2284, City Council authorized the City Manager to execute Program Supplement Agreement No. 003-M to Administering Agency-State Agreement No. 04-5300, for reimbursement of cost for right-of-way, construction and construction engineering for the Brentwood Boulevard Widening, CIP Project No. 336-3054.

On May 27, 2003, by Resolution No. 2868, City Council adopted the City’s 2003/04 - 2007/08 Capital Improvement Program (CIP) that included the Brentwood Boulevard Widening, CIP Project No. 336-3054.

BACKGROUND
This federally funded project continued the widening along Brentwood Boulevard, which improved traffic safety and circulation. Included in the project was the installation of curbs, gutters, medians, sidewalks, bike lanes and streetlights. This project modified the traffic signal at Brentwood Boulevard/Sand Creek Road and included installation of signal interconnects needed along the entire length of the Brentwood Boulevard project.

As part of the permitting process Caltrans required that all right-of-way (travel roadway) adjacent to the project and all right-of-way necessary for the widening, as part of the travel roadway, be conveyed to the State, since this is a State Highway. Due to the lengthy review process by Caltrans, the customary transfer of title never took place. The City has been contacted by Caltrans to complete the transfer process. Without completing the process the current roadway is partially owned by the City; therefore, this should be considered a housekeeping item to comply with Caltrans’ requirements.

FISCAL IMPACT
There is no fiscal impact from this item, as this item is completing the right-of-way transfer process.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING GRANT DEEDS TO THE STATE OF CALIFORNIA AND AUTHORIZING THE CITY MANAGER OR ANY OF HER DESIGNEES TO EXECUTE SAID GRANT DEEDS, HEREBY CONVEYING REAL PROPERTY TO THE STATE OF CALIFORNIA (CALTRANS), IDENTIFIED AS A PORTION OF ROADWAY PARALLEL TO HIGHWAY 4 (BRENTWOOD BOULEVARD) ON THE EAST SIDE AND WEST SIDE, GENERALLY LOCATED BETWEEN VILLAGE DRIVE AND APPLEWOOD COMMON AND ANY OTHER DOCUMENTS NECESSARY TO COMPLETE THE TRANSACTION.

WHEREAS, the right-of-way transfer never took place and Grant Deeds are required to transfer said property between the City of Brentwood and the State of California (Caltrans), as part of Highway 4 (Brentwood Boulevard).

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approves Grant Deeds to the State of California and authorizes the City Manager or any of her designees to execute said Grant Deeds, hereby conveying real property to the State of California (Caltrans), identified as a portion of roadway parallel to Highway 4 (Brentwood Boulevard) on the east side and west side, generally located between Village Drive and Applewood Common and any other documents necessary to complete the transaction.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a meeting held on the 11th day of October 2005 by the following vote:
