CITY COUNCIL AGENDA ITEM NO. 3

Meeting Date: October 11, 2005

Subject/Title: Adopt a Resolution approving Grant Deeds to the State of California (Caltrans) for a portion of the roadway along Highway 4 (Brentwood Boulevard) required for the Sunset Road Realignment, CIP Project No. 336-3012 and authorizing execution of said Grant Deed.

RECOMMENDATION
Adopt a Resolution approving Grant Deeds to the State of California and authorizing the City Manager or any of her designees to execute said Grant Deeds, hereby conveying real property to the State of California (Caltrans), identified as a portion of roadway parallel to Highway 4 (Brentwood Boulevard), generally located between Homecoming Way and Havenwood Avenue and any other documents necessary to complete the transaction.

PREVIOUS ACTION
On May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program (CIP) that included the Sunset Road Realignment, CIP Project No. 336-3012.

BACKGROUND
The Sunset Road Realignment project realigned Sunset Road to intersect Brentwood Boulevard at Grant Street instead of the old location adjacent to Marsh Creek. The project improved traffic circulation and public safety by realigning the roadway to a signalized intersection at Grant Street. This project included the construction of water and non-potable water, fiber optic line improvements and a connector road from Homecoming Way to Sunset Road, which allows residents and the Water Treatment Plant personnel to access Sunset Road and in turn allowed access to Brentwood Boulevard at a signalized intersection for safety purposes.

As part of the permitting process, Caltrans required that all right-of-way (travel roadway) adjacent to the project and all right-of-way necessary for the connection and signalization as part of the travel roadway be conveyed to the State since this is a State Highway. Due to the lengthy review process by Caltrans, the customary transfer of title never took place. The City has been contacted by Caltrans to complete the transfer process. Without completing the process the current roadway is partially owned by the City; therefore, this should be considered a housekeeping item to comply with Caltrans’ requirements.

FISCAL IMPACT
There is no fiscal impact from this item, as this item is completing the right-of-way transfer process.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING GRANT DEEDS TO THE STATE OF CALIFORNIA AND AUTHORIZING THE CITY MANAGER OR ANY OF HER DESIGNEES TO EXECUTE SAID GRANT DEEDS, HEREBY CONVEYING REAL PROPERTY TO THE STATE OF CALIFORNIA (CALTRANS), IDENTIFIED AS A PORTION OF ROADWAY PARALLEL TO HIGHWAY 4 (BRENTWOOD BOULEVARD), GENERALLY LOCATED BETWEEN HOMECOMING WAY AND HAVENWOOD AVENUE AND ANY OTHER DOCUMENTS NECESSARY TO COMPLETE THE TRANSACTION.

WHEREAS, on May 25, 2004, by Resolution No. 2004-113, City Council adopted the 2004/05 – 2008/09 Capital Improvement Program (CIP), that included the Sunset Road Realignment, CIP Project No. 336-3012; and

WHEREAS, the State of California (Caltrans) requires that when widening and improvements are constructed on Highway 4 (Brentwood Boulevard), that the right-of-way for these improvements are conveyed to the State; and

WHEREAS, the right-of-way transfer never took place and a Grant Deed is required to transfer said property between the City of Brentwood and the State of California (Caltrans) as part of Highway 4 (Brentwood Boulevard).

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approves Grant Deeds to the State of California and authorizes the City Manager or any of her designees to execute said Grant Deeds, hereby conveying real property to the State of California (Caltrans), identified as a portion of roadway parallel to Highway 4 (Brentwood Boulevard), generally located between Homecoming Way and Havenwood Avenue and any other documents necessary to complete the transaction.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a meeting held on the 11th day of October 2005 by the following vote:
