CITY COUNCIL AGENDA ITEM NO. 2

Meeting Date: October 11, 2005

Subject/Title: Adopt a Resolution approving a Grant Deed to the State of California (Caltrans) for a portion of the roadway along Highway 4 (Brentwood Boulevard) required for the Brentwood Boulevard Curve, CIP Project No. 336-3100 and authorizing execution of said Grant Deed.

RECOMMENDATION
Adopt a Resolution approving a Grant Deed to the State of California and authorizing the City Manager or any of her designees to execute said Grant Deed, hereby conveying real property to the State of California (Caltrans) identified as a portion of roadway parallel to Highway 4 (Brentwood Boulevard), generally known as the Safeway curve, located southwest of Second Street and any other documents necessary to complete the transaction.

PREVIOUS ACTION
In August 1999, City Council authorized the application for Hazard Elimination Safety Program funding in the amount of $450,000, for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On February 8, 2000, City Council authorized the application of Federal Surface Transportation Program funding for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On May 28, 2002, by Resolution No. 2549, City Council adopted the City’s 2002/03 - 2006/07 Capital Improvement Program (CIP) that included the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On August 27, 2002, by Resolution No. 2648, City Council authorized the City Manager to execute Program Supplement Agreement No. 005-M Administering Agency-State Agreement for the Brentwood Boulevard Curve, CIP Project No. 336-3100, for funds from both the Hazard Elimination Safety Program and the Federal Surface Transportation Program.

BACKGROUND
This federally funded project realigned the Brentwood Boulevard curve between Second Street and Pine Street at Safeway. The project modified the super-elevation to smooth out the curve, widen the travel lanes, install a raised median and landscape both the median and parkway on both sides. The super-elevation and larger radius of the curve was to improve the overall safety at this curve.

As part of the permitting process, Caltrans required that the right-of-way obtained by the City as part of the travel roadway, be conveyed to the State since this is a State Highway. Due to the lengthy review process by Caltrans, the customary transfer of title never took place. The City has been contacted by Caltrans to complete the transfer process. Without completing the process, the current roadway is partially owned by the City; therefore, this should be considered a housekeeping item to comply with Caltrans’ requirements.

FISCAL IMPACT
There is no fiscal impact from this item, as this item is completing the right-of-way transfer process.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A GRANT DEED TO THE STATE OF CALIFORNIA AND AUTHORIZING THE CITY MANAGER OR ANY OF HER DESIGNEES TO EXECUTE SAID GRANT DEED, HEREBY CONVEYING REAL PROPERTY TO THE STATE OF CALIFORNIA (CALTRANS) IDENTIFIED AS A PORTION OF ROADWAY PARALLEL TO HIGHWAY 4 (BRENTWOOD BOULEVARD), GENERALLY KNOWN AS THE SAFEWAY CURVE, LOCATED SOUTHWEST OF SECOND STREET AND ANY OTHER DOCUMENTS NECESSARY TO COMPLETE THE TRANSACTION.

WHEREAS, in August 1999, City Council authorized the application for Hazard Elimination Safety Program funding in the amount of $450,000, for the Brentwood Boulevard Curve, CIP Project No. 336-3100; and

WHEREAS, on February 8, 2000, City Council authorized the application of Federal Surface Transportation Program funding for the Brentwood Boulevard Curve, CIP Project No. 336-3100; and

WHEREAS, on May 28, 2002, by Resolution No. 2549, City Council adopted the City’s 2002/03 - 2006/07 Capital Improvement Program (CIP) that included the Brentwood Boulevard Curve, CIP Project No. 336-3100; and

WHEREAS, on August 27, 2002, by Resolution No. 2648, City Council authorized the City Manager to execute Program Supplement Agreement No. 005-M Administering Agency-State Agreement for the Brentwood Boulevard Curve, CIP Project No. 336-3100, for funds from both the Hazard Elimination Safety Program and the Federal Surface Transportation Program; and

WHEREAS, the State of California (Caltrans) requires that when widening and improvements are constructed on Highway 4 (Brentwood Boulevard), that the right-of-way for these improvements are conveyed to the State; and

WHEREAS, the right-of-way transfer never took place and a Grant Deed is required to transfer said property between the City of Brentwood and the State of California (Caltrans) as part of Highway 4 (Brentwood Boulevard).

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood approves a Grant Deed to the State of California and authorizes the City Manager or any of her designees to execute said Grant Deed, hereby conveying real property to the State of California (Caltrans) identified as a portion of roadway parallel to Highway 4 (Brentwood Boulevard), generally known as the Safeway curve, located southwest of Second Street and any other documents necessary to complete the transaction.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a meeting held on the 11th day of October 2005 by the following vote:
