RECOMMENDATION
Adopt a Resolution amending the 2005/06 – 2009/10 Capital Improvement Program (CIP) to include the budget for the Pedestrian and Bicycle Safety Program.

PREVIOUS ACTION
On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program (CIP).

On September 13, 2005, City Council approved Resolution No. 2005-221, authorizing the City Manager to execute the Funding Agreement with the State of California Office of Traffic Safety for a safety grant in the amount of $138,275.

BACKGROUND
The California Office of Traffic Safety (OTS) makes funds available to local government for the purposes of reducing vehicle, bicycle and pedestrian collisions and making public roadways safer. Funding is based upon the magnitude and severity of the problems identified and availability of funds.

A “concept paper” was submitted by staff from the Engineering and Finance Departments requesting a grant in the amount of $138,275 in the Pedestrian and Bicycle Safety program area, due to the need shown by the OTS ranking. Of this grant, $56,253 will pay for the purchase of equipment and all appurtenances for in-pavement lighted crosswalks. The City of Brentwood must pay for the installation costs associated with the lighted crosswalks.

FISCAL IMPACT
The attached CIP budget sheet reflects funding for the purchase and installation of the in-pavement lighted crosswalks for a total amount of $129,253. Of this amount, $73,000 is requested from the General Fund and $56,253 will be reimbursed through the OTS Safety Grant. Claims for reimbursable costs will be submitted quarterly per the executed agreement. This is a one-time cost.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AMENDING THE 2005/06 – 2009/10 CAPITAL IMPROVEMENT PROGRAM (CIP) TO INCLUDE THE BUDGET FOR THE PEDESTRIAN AND BICYCLE SAFETY PROGRAM.

WHEREAS, the Office of Traffic Safety (OTS) administers a federal grant program using federal funds apportioned to California under the National Highway Safety Act and the Transportation Equity Act for the 21st Century (TEA-21) for programs designed to reduce deaths, injuries and economic losses resulting from traffic related collisions; and

WHEREAS, OTS solicits project proposals from each region for this program each winter for implementation beginning in the following Federal fiscal year; and

WHEREAS, the City of Brentwood recognizes the traffic safety risks that children face while bicycling and on foot; and

WHEREAS, based on the “concept paper” submitted for the City of Brentwood Pedestrian and Bicycle Safety Program, OTS has approved funding for the project in the amount of $138,275 for the period from October 1, 2005 to December 31, 2007; and

WHEREAS, the intent of the Pedestrian and Bicycle Safety Program is to reduce pedestrian and bicycle collisions with a combination of education, enforcement and engineering technology with collision-tracking software and installation of in-pavement lighted crosswalks; and

WHEREAS, the City of Brentwood is responsible for funding the installation of lighted crosswalks and appurtenances; and

WHEREAS, a budget for the Pedestrian and Bicycle Safety Program has been created to fund the above installation; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the 2005/06 – 2009/10 Capital Improvement Program (CIP) is hereby amended to include the budget for the Pedestrian and Bicycle Safety Program.
