RECOMMENDATION
Adopt a Resolution authorizing the City Manager to execute a Funding Agreement between the California Office of Traffic Safety and the City of Brentwood in the amount of $138,275 for the Pedestrian and Bicycle Safety Program.

BACKGROUND
The California Office of Traffic Safety (OTS) makes funds available to local government for the purposes of reducing vehicle, bicycle and pedestrian collisions and making public roadways safer. Funding is based upon the magnitude and severity of the problems identified and availability of funds.

Because of the need shown by the OTS ranking, a “concept paper” was submitted by staff of the Engineering and Finance Departments requesting a grant in the amount of $138,275, in the Pedestrian and Bicycle Safety program area. The grant will provide funding to increase safety awareness among pedestrians, bicyclists and motorists, using education, enforcement and engineering. The program will include Police Officer and Community Service Officer overtime hours for community outreach activities, educational material, bicycle helmets, awards and incentives for students with a City sponsored Bicycle Rodeo, equipment for in-pavement lighted crosswalks and purchase of collision tracking and reporting software for use by both the Engineering and Police Departments. In a letter dated May 20, 2005, we were advised that our concept paper was successful and an agreement has been developed by City and OTS staff for signature.

FISCAL IMPACT
The total amount of the award is $138,275. There is no matching requirement for this grant; however, the OTS program will only provide funds for equipment for the in-pavement lighted crosswalk lights, not installation. Installation of the lighted crosswalks and appurtenances will be funded with a new CIP Project (OTS Pedestrian and Bicycle Safety Program) to be agendized for review and approval on September 27, 2005.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A FUNDING AGREEMENT BETWEEN THE CALIFORNIA OFFICE OF TRAFFIC SAFETY (OTS) AND THE CITY OF BRENTWOOD IN THE AMOUNT OF $138,275, FOR THE PEDESTRIAN AND BICYCLE SAFETY PROGRAM.

WHEREAS, the Office of Traffic Safety (OTS) administers a Federal Grant Program using Federal funds apportioned to California under the National Highway Safety Act and the Transportation Equity Act for the 21st Century (TEA-21) for programs designed to reduce deaths, injuries and economic losses resulting from traffic related collisions; and

WHEREAS, OTS solicits project proposals from each region for this program each winter, for implementation beginning in the following Federal fiscal year; and

WHEREAS, the City of Brentwood recognizes the traffic safety risks that children face while bicycling and on foot; and

WHEREAS, based on the concept paper submitted for the City of Brentwood Pedestrian and Bicycle Safety Program, OTS has approved funding for the project in the amount of $138,275, for the period from October 1, 2005 to December 31, 2007; and

WHEREAS, the intent of the Pedestrian and Bicycle Safety Program is to reduce pedestrian and bicycle collisions with a combination of education, enforcement and engineering technology, with collision-tracking software and installation of in-pavement lighted crosswalks; and

WHEREAS, the OTS requires the City of Brentwood to fund the installation of the lighted crosswalks; and

WHEREAS, a Resolution is necessary to authorize the Funding Agreement and designate the City of Brentwood’s authorized representative.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the City Manager be authorized to execute a Funding Agreement between the California Office of Traffic Safety (OTS) and the City of Brentwood in the amount of $138,275, for the pedestrian and bicycle safety program.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 13th day of September 2005 by the following vote:
