Subject/Title: Approve the Contract Documents and Award the Construction Contract for the 2005 Pavement Management Program, CIP Project No. 336-3083.

RECOMMENDATION
Approve a Resolution approving the contract documents and awarding the construction contract for the 2005 Pavement Management Program, CIP Project No. 336-3083, to Bay Cities Paving & Grading, Inc. and authorizing the City Manager to execute the agreement and necessary documents in the amount of $643,221.50, plus a 10% contingency, for a total amount of $707,543.65.

PREVIOUS ACTION
On May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included the Pavement Management Program, CIP Project No. 336-3083.

On April 12, 2005, by Resolution No. 2005-81, City Council authorized the City Manager to execute a Professional Services Agreement with Harris & Associates for design services for the 2005/06 Pavement Management Program, CIP Project No. 336-3083.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program that included the Pavement Management Program, CIP Project No. 336-3083.

On June 14, 2005, by Resolution No. 2005-134, City Council authorized the City Manager to execute a revised Professional Services Agreement with Harris & Associates for design services for the 2005/06 Pavement Management Program, CIP Project No. 336-3083.

BACKGROUND
The City advertised the project for construction beginning Wednesday, August 3, 2005 and bids were opened on August 30, 2005. A total of three (3) bids were received. The bids were reviewed and the lowest responsive, responsible bid was received from Bay Cities Paving & Grading, Inc.

The three (3) bids were as follows:

1. Bay Cities Paving & Grading, Inc. $643,221.50
2. MCK Services $651,099.45
3. Ghilotti Bros. Inc. $772,434.00

Staff recommends the award of the construction contract for the 2005 Pavement Management Program, CIP Project No. 336-3083 to Bay Cities Paving & Grading, Inc. for the amount of $643,221.50, plus a 10% contingency, for a total amount of $707,543.65.

Typically, the City conducts a survey of existing roads every three years and after analyzing the data and input from staff, determination is made on which roads need immediate and urgent pavement repairs. These repairs will reduce the maintenance cost for these portions of road for many years to come. The list of streets included in this year’s program is as follows:

Re-Construction:
• Central Blvd. (between Dainty Avenue and Minnesota Avenue)
• Windsor Way (between 1588 Windsor Way and South end at Windsor Way Park)

Asphalt Overlay:
• Sweet Grass Drive
• Darby Drive
• Essex Drive (between Darby Drive and Coventry Circle)

Slurry Seal Streets:
• Fairview Avenue (between Central Blvd. and Sand Creek Road)
• Fairview Avenue (between Apricot Way and 100’ north of Grant Street)
• Sea Vista Court
• Tidewater Court
• Lagoon Court
• Ocean Court
• Sea Island Court
• Bay Court
• Sea Breeze Court
• Outrigger Circle
• Woodsong Lane
• Jericho Court
• Barrington Court
• Schilling Court
• Cornsilk Court

FISCAL IMPACT
The 2005 Pavement Management Program construction contract amount is $643,221.50, plus a 10% contingency, for a total cost of $707,543.65. The cost is included within the Pavement Management Program budget which was approved by City Council as part of the 2005/06 – 2009/10 Capital Improvement Program.

This project is funded through Measure C and the General Fund.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING THE CONTRACT DOCUMENTS AND AWARD THE CONSTRUCTION CONTRACT FOR THE 2005 PAVEMENT MANAGEMENT PROGRAM, CIP PROJECT NO. 336-3083, TO BAY CITIES PAVING & GRADING, INC. AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT AND NECESSARY DOCUMENTS IN THE AMOUNT OF $643,221.50, PLUS A 10% CONTINGENCY, FOR A TOTAL AMOUNT OF $707,543.65.

WHEREAS, on June 14, 2005, by Resolution No. 2005-134, City Council authorized the City Manager to execute a revised Professional Services Agreement with Harris & Associates for design services for the 2005/06 Pavement Management Program, CIP Project No. 336-3083; and

WHEREAS, the bid opening for said project was held on August 30, 2005 and Bay Cities Paving & Grading, Inc. was determined to have provided the lowest, responsible base bid of $643,221.50 for the 2005/06 Pavement Management Program, CIP Project No. 336-3083.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve the contract documents and award the construction contract for the 2005/06 Pavement Management Program, CIP Project No. 336-3083, to Bay Cities Paving & Grading, Inc. in the amount of $643,221.50, plus a 10% contingency, for a total amount of $707,543.65.
