Subject/Title: Adopt a Resolution accepting the Work Performed by Bay Cities Paving & Grading Inc., for the 2004 Pavement Management Program, CIP Project No. 336-3083.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading Inc. for the 2004 Pavement Management Program, CIP Project No. 336-3083 and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 27, 2003, by Resolution No. 2868, City Council adopted the City’s 2003/04 – 2007/08 Capital Improvement Program that included the 2004 Pavement Management Program, CIP Project No. 336-3083.

On May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included the Pavement Management Program, CIP Project No. 336-3083.

On June 22, 2004, by Resolution No. 2004-150, City Council authorized the City Manager to award a contract for construction to Bay Cities Paving & Grading Inc. for the 2004 Pavement Management Program, CIP Project No. 336-3083 and execute change orders not to exceed 10% of the contract amount.

BACKGROUND
The City conducts a survey of existing roads every three years and after analyzing the data and input from staff, determination is made on which roads need immediate and urgent pavement repairs.

The 2004 Pavement Management Program consisted of base failure repairs and asphalt rubber overlay on Balfour Road (between Marsh Creek Bridge and Fairview Avenue) and slurry seal on Sand Creek Road (between Brentwood Blvd. and 500’ west of Brentwood Blvd.), which are major east-west corridors in the City of Brentwood between the Highway 4 Bypass and Brentwood Boulevard. Cape seals were also completed on Randy Way, Quail Court, Dove Court and Laurie Drive. The asphalt rubber helped reduce road noise along Balfour Road as well as improve traffic conditions.

These improvements have been constructed in conformance with the approved plans and specifications, submittals and the approved changes in scope.

FISCAL IMPACT
Due to the timing of the 2004 Pavement Management Program, the CIP funds budgeted in fiscal year 2003/04 were not utilized. Funds were utilized from the approved 2004/05 CIP budget.

The final contract amount for Bay Cities Paving & Grading Inc. is $649,240.45 which is below the original contract amount of $655,834.30. This amount is well within the Capital Improvement Program budget proposed for 2004/05. City staff will release the retention payment to Bay Cities Paving & Grading Inc. upon filing of the Notice of Completion.

This project is funded through Measure C and the General Fund.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY BAY CITIES PAVING & GRADING INC., FOR THE 2004 PAVEMENT MANAGEMENT PROGRAM, CIP PROJECT NO. 336-3083 AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the work performed by Bay Cities Paving & Grading Inc. for the Pavement Management Program, CIP Project No. 336-3083, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for this project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did on the 8th day of June 2004 enter into an agreement with Bay Cities Paving & Grading Inc., for 2004 Pavement Management Program, CIP Project No. 336-3083.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said project.

On the 13th day of September 2005, said contract as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
