Subject/Title: Adopt a Resolution accepting Improvements for Subdivision No. 8180, Paradise Creek, developed by Discovery Builders, located south of Balfour Road and east of Guthrie Lane.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Subdivision No. 8180, Paradise Creek, developed by Discovery Builders, located south of Balfour Road and east of Guthrie Lane.

PREVIOUS ACTION
On May 16, 2000, by Resolution No. 99-34, Planning Commission of the City of Brentwood, approved Tentative Subdivision Map No. 8180 with conditions.

On July 23, 2002, by Resolution No. 2620, City Council approved Final Map Subdivision No. 8180, accepted the offers of dedication shown on the final map subject to acceptance of improvements, accepted improvement securities and approved the Subdivision Improvement Agreement.

BACKGROUND
This subdivision, located south of Balfour Road and east of Guthrie Lane, contains 15 single-family residential lots. All public improvements required by the conditions of approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optic conduit. Discovery Builders has provided a Maintenance Bond to cover the twelve-month warranty period for the improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 693 LF of 8” sewer lines, 605 LF of 8” waterlines, 9,682 LF of various diameter storm drain lines, 1,570 LF of curb and gutter, 1,413 LF of 5’ wide sidewalk, 515 LF of pavement, 620 LF of joint trench including fiber optic conduit, 5 streetlights and 7,850 SF of landscaping and irrigation.

When the Final Map was approved by City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $8,000, associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 99-8 has been formed for this subdivision and will be responsible for the street lighting and public landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD HEREBY ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; HEREBY ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; HEREBY ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; HEREBY ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8180, PARADISE CREEK, DEVELOPED BY DISCOVERY BUILDERS, LOCATED SOUTH OF BALFOUR ROAD AND EAST OF GUTHRIE LANE.

WHEREAS, on May 16, 2000, by Resolution No. 99-34, Planning Commission of the City of Brentwood, approved Tentative Subdivision Map No. 8180 with conditions; and

WHEREAS, on July 23, 2002, by Resolution No. 2620, City Council approved Final Map Subdivision No. 8180, accepted the offers of dedication shown on the final map subject to acceptance of improvements, accepted improvement securities and approved the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for Subdivision No. 8180, Paradise Creek, developed by Discovery Builders, for maintenance; and

1. All offers of dedication for rights-of-way, easements, abutter’s rights, sub-surface mineral and water rights and parcels of land intended for public use as shown on the final map are hereby accepted.
2. The Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.
3. The Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.
4. The City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
