Subject/Title: Adopt a Resolution accepting the work performed by Wingard Engineering, Inc. on Balfour Road, for the Citywide Traffic Signal Interconnect Program – Phase I, CIP Project No. 336-3150.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Wingard Engineering, Inc. on Balfour Road, for the Citywide Traffic Signal Interconnect Program – Phase I, CIP Project No. 336-3150 and direct the City Clerk to file the Notice of Completion with the County Recorder.

PREVIOUS ACTION
On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program (CIP), which included the Citywide Traffic Signal Interconnect Program – Phase I, CIP Project No. 336-3150.

BACKGROUND
This project is combined with the Regional Signal Timing Program, which is a grant program that was awarded by Metropolitan Transportation Commission (MTC). This grant is to provide for the coordination of traffic signals along Balfour Road. This project consists of the construction and installation of missing links of interconnect conduit, cables and pull boxes along Balfour Road to improve signal coordination. The prime consultant for the grant program is TJKM Transportation Consultants. TJKM retained K2 & Associates, Inc. as a sub consultant to prepare the signal timing for the thirteen (13) traffic signals on Balfour Road, between West Country Club Drive/American Avenue on the west and Brentwood Boulevard/Highway 4 on the east. The regional signal timing program required that the interconnect system be installed and operational prior to implementation of the signal timing.

Staff sent out request for proposals and received estimates from Wingard Engineering Inc., Tennyson Electric Inc. and St. Francis Electric. . Wingard Engineering Inc. submitted the lowest bid. The project scope of work involved pulling 3,000 linear feet of interconnect cable through the existing conduit and terminating the interconnect cable in the traffic signal controller cabinet. The City Manager executed a professional services agreement with Wingard Engineering, Inc. on April 6, 2005, in the amount of $8,850, plus a 15% contingency, for the Citywide Traffic Signal Interconnect Program – Phase I, CIP Project No. 336-3150.

Per the City of Brentwood’s Purchasing Policy, any project under $50,000 requires only City Manager approval. Therefore, this project did not necessitate City Council action.

During the construction, the contractor found a section of conduit that was filled with concrete and gravel and another section of conduit that had been damaged. The contractor was asked to provide estimates for this unanticipated work, which included excavating 350 linear feet of damaged conduit sections, replacing and restoring the surface area, including sidewalk, curb and gutter and landscaping. The estimate received was in the amount of $11,509.28. On June 14, 2005, the City Manager executed Amendment One with Wingard Engineering, Inc. to increase the total contract amount to $21,686.78, for the Citywide Traffic Signal Interconnect Program – Phase I, CIP Project No. 336-3150.

At this time, the Citywide Traffic Signal Interconnect Program – Phase I improvements on Balfour Road are complete and operational and have been inspected for conformance with the approved traffic signal specifications. The contractor has met all the contractual requirements for the City to accept the work and direct the City Clerk to file the Notice of Completion with the County Recorder.

FISCAL IMPACT
The work encompasses improvements associated with the agreement for a total contact amount of $21,686.78. The following is a breakdown of the costs for this project:

Original Agreement $10,177.50
Amendment One $11,509.28
TOTAL $21,686.78

The work is complete and within budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY WINGARD ENGINEERING, INC. ON BALFOUR ROAD, FOR THE CITYWIDE TRAFFIC SIGNAL INTERCONNECT PROGRAM – PHASE I, CIP PROJECT NO. 336-3150 AND DIRECT THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, this project consist of the construction and installation of missing links of interconnect conduit, cables and pull boxes along Balfour Road to improve signal coordination; and

WHEREAS, staff sent out request for proposals for this work and Wingard Engineering Inc., submitted the lowest bid; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the work performed by Wingard Engineering, Inc. on Balfour Road, for the Citywide Traffic Signal Interconnect Program – Phase I, CIP Project No. 336-3150, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file the Notice of Completion with the County Recorder for this project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on April 6, 2005 with Wingard Engineering, Inc. for work performed on Balfour Road for CIP Project No. 336-3150 for installation of traffic signal interconnect.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work.

On the 23rd day of August 2005, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
