Subject/Title: Adopt a Resolution accepting the work performed by Wingard Engineering, Inc. for the Central Boulevard / Griffith Lane Traffic Signal, CIP Project No. 336-3057.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Wingard Engineering, Inc. for the Central Boulevard / Griffith Lane Traffic Signal, CIP Project No. 336-3057 and direct the City Clerk to file the Notice of Completion with the County Recorder.

PREVIOUS ACTION
On June 12, 2001, City Council awarded a contract to Tennyson Electric Company to construct the traffic signal at the intersection of Central Boulevard / Griffith Lane (CIP Project No. 336-3057).

On August 12, 2003, the City Council accepted the work performed by Tennyson Electric Company for traffic signal installation at the intersection of Central Boulevard / Griffith Lane (CIP Project No. 336-3057).

On May 25, 2004, by Resolution No. 2004-113, City Council approved the 2004/05 - 2008/09 Capital Improvement Program (CIP), which included the Central Boulevard / Griffith Lane Traffic Signal, CIP Project No. 336-3057.

BACKGROUND
This project consist of the installation of a battery backup system and countdown type pedestrian signal modules to an existing traffic signal. These improvements will provide additional safety for pedestrians, bicyclists and motorists and in the event of a power outage, the signal will still remain operational.

Staff sent out request for proposals on April 7, 2005 to Wingard Engineering, Inc., St. Francis Electric, Richard A. Heaps, and Tennyson Electric. Wingard Engineering, Inc. submitted the lowest bid for the project. On April 28, 2005, the City Manager executed a professional services agreement with Wingard Engineering Inc. in the amount of $11,570, plus a 10% contingency for the Central Boulevard / Griffith Lane Traffic Signal, CIP Project No. 336-3057.

Per the City of Brentwood’s Purchasing Policy, any project under $50,000 requires only City Manager approval. Therefore, this project did not necessitate City Council action.

At this time, the Central Boulevard / Griffith Lane Traffic Signal improvements are complete and operational and have been inspected for conformance with the approved traffic signal specifications. The contractor has met all the contractual requirements for the City to accept the work. This acceptance by the City Council is an administrative action necessary to formally close the project.

FISCAL IMPACT
The work encompasses improvements associated with the agreement for a total contact amount of $11,570, plus a 10% contingency, for a total amount of $12,727. The work is complete and within the estimated budget for these improvements.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY WINGARD ENGINEERING, INC. FOR THE CENTRAL BOULEVARD / GRIFFITH LANE TRAFFIC SIGNAL, CIP PROJECT NO. 336-3057 AND DIRECT THE CITY CLERK TO FILE THE NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, this project consist of the installation of a battery backup system and countdown type pedestrian signal modules to an existing traffic signal; and

WHEREAS, staff sent out request for proposals for the project and Wingard Engineering, Inc. submitted the lowest bid; and

WHEREAS, the City Manager executed a professional services agreement with Wingard Engineering Inc. in the amount of $11,570, plus a 10% contingency; and

WHEREAS, the improvements are now complete and operational and have been inspected for conformance with the approved traffic signal specifications; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the worked performed by Wingard Engineering, Inc. for the Central Boulevard / Griffith Lane Traffic Signal, CIP Project No. 336-3057, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for the project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did enter into an agreement on April 28, 2005, with Wingard Engineering, Inc. for work performed for the Central Boulevard / Griffith Lane Traffic Signal, CIP Project No. 336-3057 for installation of battery backup system and the countdown type pedestrian signal modules.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete said work.

On the 23rd day of August 2005, said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
