Subject/Title: Adopt a Resolution executing a Professional Services Agreement with Kimley-Horn and Associates, Inc. to provide Design Services for the Site Design of Well #15, CIP Project No. 562-5631.

RECOMMENDATION
Adopt a Resolution authorizing the City Manager to execute a Professional Services Agreement and related documents with Kimley-Horn and Associates, Inc. to provide design services in the amount of $118,198.05, plus a 10% contingency, for the site design of Well #15, CIP Project No. 562-5631.

PREVIOUS ACTION
On October 14, 2003, by Resolution No. 3002, City Council authorized the City Manager to execute a Professional Services Agreement with Luhdorff and Scalmanini Consulting Engineers, Inc., for exploratory test hole drilling, well monitoring, site evaluation and pre-design report for Well #15, CIP Project No. 562-5631, amended the CIP Project Budget and authorized the City Manager to approve change orders up to 10% of the contract amount.

On February 22, 2005, by Resolution No. 2005-46, City Council authorized the City Manager to execute contract change orders in the amount of $151,865.67, plus a 10% contingency, for a total change order amount of $167,052.24, with Luhdorff and Scalmanini Consulting Engineers, Inc. for Well #15, CIP Project No. 562-5631.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program (CIP), which included Well #15, CIP Project No. 562-5631.

BACKGROUND
Well #15 is located across from the City of Brentwood’s Corporation Yard on Elkins Way. The well is currently operating on temporary power, chemical injection facilities and controls and is protected by a temporary fence. This contract will provide for the site design of Well #15, including the design of the control system, chemical systems, coordination with utilities, permanent fence and gates and site work, as well as services during the construction of these improvements.

The City requested a proposal from Kimley-Horn and Associates for design services. Kimley-Horn has done previous work for the City of Brentwood including the Home Depot Pump Station, the Zone 1 Reservoir 1.3 and other water storage and transmission projects. The City’s working relationship with Kimley-Horn’s proposed Project Manager, Chad Coleman, and Principal-in-Charge, Dennis Clift, on previous projects has been very positive. They have provided exemplary service to Brentwood on previous water storage and transmission projects.

FISCAL IMPACT
The total cost for this proposal is $118,198.05, plus a 10% contingency of $11,819.81, for a total amount of $130,017.86, which has been included in the approved 2005/06 – 2009/10 Capital Improvement Program Budget. The total project budget is $1,327,000.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER TO EXECUTE A PROFESSIONAL SERVICES AGREEMENT AND RELATED DOCUMENTS WITH KIMLEY-HORN AND ASSOCIATES TO PROVIDE DESIGN SERVICES IN THE AMOUNT OF $118,198.05, PLUS A 10% CONTINGENCY, FOR THE SITE DESIGN OF WELL #15, CIP PROJECT NO. 562-5631.

WHEREAS, on May 24, 2005, by Resolution No. 2005-115, City Council adopted the City’s 2005/06 – 2009/10 Capital Improvement Program (CIP), which included Well #15, CIP Project No. 562-5631; and

WHEREAS, this contract will provide the City of Brentwood the contract documents and construction service support for the site design of Well #15, including the design of the control system, chemical systems, permanent fence and gates and site work; and

WHEREAS, due to their experience and positive working relationship with the City, staff requested a proposal from Kimley-Horn and Associates for this work.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby authorizes the City Manager to execute a Professional Services Agreement and related documents with Kimley-Horn and Associates to provide Design Services in the amount of $118,198.05, plus a 10% contingency of $11,819.81, for a total amount of $130,017.86, for the site design of Well #15, CIP Project No. 562-5631.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 23rd day of August 2005 by the following vote:
