Subject/Title: Adopt a Resolution to approve a thirty (30) day extension of Interim Resolution No. 2005-182 and continue the Interim Regional Transportation Development Impact Mitigation Fee in full force and in effect until September 13, 2005.

RECOMMENDATION
Adopt a Resolution to approve a thirty (30) day extension of Interim Resolution No. 2005-182 and continue the Interim Regional Transportation Development Impact Mitigation Fee in full force and in effect until September 13, 2005, at which time the fees approved by Resolution No. 2005-180 become effective.

PREVIOUS ACTION
On July 12, 2005, City Council adopted Interim Resolution No. 2005-182, which established a Regional Transportation Development Impact Mitigation Fee on an interim basis for 30 days. A copy of Interim Resolution No. 2005-182 and Exhibit “A” are attached for reference with regard to the purpose and justification for the interim fee increase.

BACKGROUND
On July 12, 2005, City Council adopted Resolution No. 2005-180, approving and adopting the East Contra Costa Regional Fee Program update, including a revised schedule of regional transportation development impact mitigation fees and a revised projects list of transportation improvements. This Resolution took effect immediately and the fee shall be effective on September 13, 2005, which is sixty (60) days from the date of the Resolution adoption. A copy of Resolution No. 2005-180, is attached for reference with regards to the Regional Transportation Development Impact Mitigation Fee’s history, justification, purpose, payment and use of revenue.

City Council also adopted Interim Resolution No. 2005-182, per Government Code Section 66017, putting the Regional Transportation Development Impact Mitigation fee immediately into effect in order to maintain the public health, safety and welfare of Brentwood’s citizens, especially as it relates to new development within the City. Per the above Government Code this Interim Resolution is only for thirty (30) days, but this Government Code does allow the further extension of this Interim Resolution for another thirty (30) days at which time the fee adopted by City Council Resolution No. 2005-180 shall be effective. Without the extension, the fee increase will expire on August 13, 2005.

FISCAL IMPACT
Proposed Regional Development Fee for approval is a follows:

Single family residential per dwelling unit $15,000.00
Multi family residential per dwelling unit $ 9,207.92
Commercial per square foot of gross floor area $ 1.25
Industrial per square foot of gross floor area $ 1.10
Office per square foot of gross floor area $ 1.10
Other per peak hour trip as determined $15,000.00/trip

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A THIRTY (30) DAY EXTENSION OF INTERIM RESOLUTION NO. 2005-182 AND CONTINUE THE INTERIM REGIONAL TRANSPORTATION DEVELOPMENT IMPACT MITIGATION FEE IN FULL FORCE AND IN EFFECT UNTIL SEPTEMBER 13, 2005, AT WHICH TIME THE FEES APPROVED BY RESOLUTION NO. 2005-180 BECOME EFFECTIVE.


WHEREAS, City Council of the City of Brentwood adopted Interim Resolution No. 2005-182 on July 12, 2005, which established an interim Regional Transportation Development Impact Mitigation Fee applicable to new commercial, office, industrial and residential developments in the City; and

WHEREAS, City Council found the adoption of the interim Regional Transportation Development Impact Mitigation Fee was necessary to protect the public health, welfare and safety by assuring the earliest practical construction of the improvements, both those identified in the existing regional transportation fee programs and those additional improvements identified in the report; and

WHEREAS, Interim Resolution No. 2005-182, is set to expire on September 13, 2005, by operation of law pursuant to Section 66017(b) of the Government Code of the State of California; and

WHEREAS, City Council desires to enact a thirty (30) day extension of Interim Resolution No. 2005-182, until the effective date of Resolution No. 2005-180.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood hereby approves the extension of Interim Resolution No. 2005-182 and continue the interim Regional Transportation Impact Mitigation Fee amounts shown in Exhibit “A” of Interim Resolution No. 2005-182, in full force and in effect until September 13, 2005 which is thirty (30) days from the pending expiration date of August 13, 2005.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 9th day of August 2005 by the following vote:
