Subject/Title: Adopt a Resolution accepting Improvements for Subdivision No. 8722, Brookdale Court, developed by Discovery Builders, located east of Fairview Avenue and south of Balfour Road.

RECOMMENDATION
Adopt a Resolution accepting public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Subdivision No. 8722, Brookdale Court, developed by Discovery Builders, located east of Fairview Avenue and south of Balfour Road.

PREVIOUS ACTION
On February 17, 1987, by Resolution No. 87-5, Planning Commission approved Tentative Subdivision Map No. 6492, with conditions.

On September 17, 2002, by Resolution No. 02-61, Planning Commission approved Tentative Parcel Map MS No. 358-02, with conditions.

On September 9, 2003, by Resolution No. 2975, City Council approved Final Subdivision Map No. 8722, accepting all offers of dedication, accepting improvement security and approving the Subdivision Improvement Agreement.

BACKGROUND
This subdivision, located east of Fairview Avenue and south of Balfour Road, contains 14 single-family residential lots and is the last phase of a tentative subdivision map approved in 1987. All public improvements required by the conditions of approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights, fiber optic conduit and landscaping. Discovery Builders has provided a Maintenance Bond to cover the twelve-month warranty period for the improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 325 LF of 8” sewer lines, 320 LF of 8” waterlines, 368 LF of pavement, 560 LF of curb and gutter, 745 LF of 5’ wide sidewalk, 2 streetlights, 400 LF of joint trench including fiber optic conduit and 31,027 SF of parkway landscaping. The necessary right-of-way offers of dedication and easements required for maintenance of the public improvements were offered to the City and accepted as a part of the final map. With the improvements now installed to support the new lots, it is the appropriate time to accept the improvements and begin the warranty period.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $10,700, associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax, with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 03-3 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION NO. 8722, BROOKDALE COURT, DEVELOPED BY DISCOVERY BUILDERS, LOCATED EAST OF FAIRVIEW AVENUE AND SOUTH OF BALFOUR ROAD.

WHEREAS, on February 17, 1987, by Resolution No. 87-5, Planning Commission approved Tentative Subdivision Map No. 6492, with conditions; and

WHEREAS, on September 17, 2002, by Resolution No. 02-61, Planning Commission approved Tentative Parcel Map MS No. 358-02, with conditions; and

WHEREAS, on September 9, 2003, by Resolution No. 2975, City Council approved Final Subdivision Map No. 8722, accepting all offers of dedication, accepting improvement security and approving the Subdivision Improvement Agreement; and

WHEREAS, right-of-way offers of dedication and easements required for public improvements were offered upon the final map and previously accepted by the City Council at final map approval; and

WHEREAS, the required public improvements have been completed and have been constructed in conformance with the approved improvement plans and City Standards and Specifications.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance.

BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against defects in material and workmanship for a period of twelve months is hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
