Adopt a Resolution accepting the right-of-way offers of dedication in-fee;
accepting easements, abutter’s rights and sub-surface mineral and water
rights as shown on the Final Map; accepting all public improvements for
maintenance; accepting the Subdivision Maintenance Bond and releasing the
Subdivision Improvement Securities for Subdivision No. 8421, Monteverde,
developed by Braddock and Logan, located east of Shady Willow Lane and north
of Sand Creek Road.
On January 15, 2002, by Resolution No. 02-02, Planning Commission approved
Tentative Subdivision Map No. 8421, with conditions.
On May 23, 2003, by Resolution No. 2869, City Council approved Final Map
Subdivision No. 8421, accepting the improvement securities and approving the
Subdivision Improvement Agreement.
On June 27, 2004, by Resolution No. 2004-23, City Council approved a
Reimbursement Agreement with Braddock and Logan for Master Planned Facility
This subdivision, located east of Shady Willow Lane and north of Sand Creek
Road, has been developed by Braddock and Logan and contains 54 single-family
residential lots. All public improvements required for the project have been
constructed and inspected for conformance with the approved improvement
plans including sewer, water and storm drain lines, sidewalk, paving,
streetlights, fiber optic conduit and landscaping. As a part of this project
Braddock and Logan constructed Shady Willow Lane, south of Sand Creek to
Sand Creek Road, as well as providing a pedestrian bridge over Sand Creek
and trail landscaping along Old Sand Creek Road to be used as a regional
trail. Braddock and Logan has provided a Maintenance Bond to cover the
twelve-month warranty period for all improvements.
As required by the conditions of approval and shown on the improvement
plans, the Developer has installed the following improvement quantities:
3,423 LF of 8” sewer lines, 2,473 LF of 8” waterlines, 1,276 LF of 16”
waterlines, 75,708 LF of various diameter storm drains, 5,327 LF of 5’ wide
sidewalk, 2,104 LF of pavement, 5,327 LF of curb and gutter, 21
streetlights, 23,776 SF of landscaping and a pedestrian bridge.
When the Final Map was approved by City Council, the right-of-way offers of
dedication were accepted subject to acceptance of improvements. The
improvements are now installed to support the new lots; therefore, it is the
appropriate time to accept the improvements, rights-of-way and easements as
offered on the Final Map.
Upon acceptance of improvements the City will incur annual costs in the
amount of approximately $26,000, associated with necessary maintenance of
streets, landscaping and utilities. Routine roadway maintenance will be
funded by the General Fund and Measure “C” gas tax, with sewer and water
maintenance funded through their respective enterprise funds. Landscaping
and Lighting Assessment District (LLD) No. 02-4, has been formed for this
subdivision and will be responsible for the street lighting and landscape

RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S

SUBDIVISION NO. 8421, MONTEVERDE, DEVELOPED BY BRADDOCK AND LOGAN, LOCATED
EAST OF SHADY WILLOW LANE AND NORTH OF SAND CREEK ROAD.
WHEREAS, on January 15, 2002, by Resolution No. 02-02, Planning Commission
approved Tentative Subdivision Map No. 8421, with conditions; and
WHEREAS, on May 23, 2003, by Resolution No. 2869, City Council approved
Final Map Subdivision No. 8421, accepting the improvement securities and
approving the Subdivision Improvement Agreement; and
WHEREAS, the required public improvements have been completed and
constructed in substantial conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
that the public improvements are accepted for maintenance and all offers of
dedication for rights-of-way, easements and parcels of land intended for
public use as shown on the Final Map are hereby accepted.
BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against
defects in material and workmanship for a period of twelve months are hereby
BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds
will be released within sixty (60) days of the passage of this Resolution.
BE IT FURTHER RESOLVED that the City Council of the City of Brentwood
directs the City Clerk to file this Resolution with the Recorder of Contra
