RECOMMENDATION
Adopt a Resolution approving a Drainage Fee Collection, Right-of-Way and Maintenance Agreement with Contra Costa County Flood Control and Water Conservation District for Drainage Areas 56 and 107 and authorize the City Manager to execute agreements upon annexation of future Drainage Areas into the city limits of Brentwood.

PREVIOUS ACTION
On February 25, 1992, by Resolution No. 92-11, City Council approved an Agreement with Contra Costa County Flood Control and Water Conservation District for Drainage Fee Collection, Right-of-Way and Maintenance for Drainage Areas 30B, 30C, 52A, 52B, 52C, 52D, 104, 105 and 106.

BACKGROUND
As properties develop, storm drainage improvements are required due to increased impervious surfaces and resulting run-off. Development projects are responsible for construction of storm drains in and around their project and also need to contribute to downstream or “regional” improvements upon which they have an impact. Contra Costa County Flood Control and Water Conservation District has developed Master Plans to identify these regional improvements and has enacted by Ordinance, a drainage fee to be paid by developing properties for their contribution.

The attached agreement provides for the collection of the drainage fees and defines responsibilities for right-of-way acquisition and maintenance of facilities. Agreements are currently in place between the Flood Control District and the City for all other Drainage Areas that fall within the city limits of Brentwood. The boundaries of Drainage Areas 56 and 107 incorporate property that were a part of the more recent annexations, including Vineyards and the northwest portion of the City.

FISCAL IMPACT
Per the terms of the agreement, the City of Brentwood will receive a 0.5% administrative charge from drainage fees collected to cover our collection and processing time.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A DRAINAGE FEE COLLECTION, RIGHT-OF-WAY AND MAINTENANCE AGREEMENT WITH CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT FOR DRAINAGE AREAS 56 AND 107.

WHEREAS, drainage improvements are necessary to accommodate increased impervious surfaces resulting from new development; and

WHEREAS, Contra Costa County Flood Control and Water Conservation District on August 28, 1990, adopted Ordinance No. 90-77, adopting the drainage plan and establishing Drainage Fees for Drainage Area 107; and

WHEREAS, Contra Costa County Flood Control and Water Conservation District on September 10, 2002, adopted Ordinance No. 2002-24, adopting the drainage plan and establishing Drainage Fees for Drainage Area 56; and

WHEREAS, developers are required to contribute to regional drainage facilities and improvements; and

WHEREAS, Contra Costa County Flood Control and Water Conservation District has developed an agreement to provide a mechanism for the collection of drainage fees, right-of-way acquisition and maintenance; and

WHEREAS, the City has previously executed Fee Collection, Right-of-Way and Maintenance Agreements with Contra Costa County Flood Control and Water Conservation District for Drainage Areas 30B, 30C, 52A, 52B, 52C, 52D, 104, 105 and 106 that fall within the city limits of Brentwood.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve a Fee Collection, Right-of-Way and Maintenance Agreement with Contra Costa County Flood Control and Water Conservation District for Drainage Areas 56 and 107.

BE IT FURTHER RESOLVED that the City Manager is authorized to execute Fee Collection, Right-of-Way and Maintenance Agreements with Contra Costa County Flood Control and Water Conservation District upon annexation of other Drainage Areas into the City of Brentwood.
