Subject/Title: Approve a Resolution authorizing the City Manager to execute an agreement with Garaventa Enterprises, dba Brentwood Disposal for the transfer of solid waste services in the Central Annexation area for the Rose Garden and Sterling Preserve II subdivisions.

RECOMMENDATION
Approve a Resolution authorizing the City Manager to execute an agreement with Garaventa Enterprises, dba Brentwood Disposal for the transfer of solid waste services in the Central Annexation area for the Rose Garden and Sterling Preserve II subdivisions.

There is no previous Council action.

BACKGROUND
In 1994, the City of Brentwood took over solid waste services from the privately franchised hauler, Brentwood Disposal, owned by Garaventa Enterprises. The City has been providing the solid waste services within the City’s incorporated boundaries since that time. As unincorporated areas serviced by Brentwood Disposal have been annexed into the City, Garaventa Enterprises has exercised its option under section 49520 of the State Public Resources Code and continued service of residents for up to five years before allowing the City of Brentwood to take over the collection.

Several large annexations (Northwest and O’Hara Avenue/Neroly Road) occurred in 1999. Proper notification and timetables were set at that time for these annexations. Five years later, in March 2004 solid waste services in those areas transferred over to the City from Brentwood Disposal as planned.

The Central Annexation occurred in 2001 and it was set to transfer to the City in the same manner in March 2006. However, upon mutual agreement of the City of Brentwood and Brentwood Disposal, two new subdivisions, Rose Garden and Sterling Preserve II, are being transferred before March 2006 to minimize the impact on all of the new residents who would otherwise have to start up services with the Brentwood Disposal, only to change services to the City in less than a year. This early transfer, which included just over 40 residential customers, occurred in June of 2005.

The existing active customers of Brentwood Disposal within the Central Annexation area will be transferred to the City solid waste services in March 2006, as originally planned.

Future annexations include the Yamanaka, the Rod & Gun Club and the Christ properties. The official transfer date is August 2007. At this time, there are no plans to alter this transfer date.

Staff is still awaiting final determinations from LAFCO (Local Agency Formation Commission) on the Vineyards at Marsh Creek and the School District’s annexations. Once we receive documentation from LAFCO, Brentwood Disposal will be notified and another five-year term will be established for conclusion of their services in these areas to any existing customers. The transfer of these services will be handled in the same manner as previous transfers. Local Agency Formation Commission stated we should have these determinations in the near future.

FISCAL IMPACT
The fiscal impact of the early transfer of the two subdivisions, which would have occurred in March 2006, includes less than $500 direct labor costs to deliver the carts, plus the additional purchase of three carts per home (approximately $120/home) totaling about $5,000 in carts for a combined total of approximately $5,500 in expenses.

The anticipated revenues for monthly service by the 40 plus customers will, of course offset this expense.

RESOLUTION NO.

APPROVE A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH GARAVENTA ENTERPRISES, DBA BRENTWOOD DISPOSAL FOR THE TRANSFER OF SOLID WASTE SERVICES IN THE CENTRAL ANNEXATION AREA FOR THE ROSE GARDEN AND STERLING PRESERVE II SUBDIVISIONS.

WHEREAS, Garaventa Enterprises, dba Brentwood Disposal is a solid waste disposal company that provides solid waste disposal services to the unincorporated areas of Brentwood and to previously annexed areas; and

WHEREAS, Public Resources Code (PRC) 49520 requires the City to give five-year notice to any authorized solid waste enterprise that has been lawfully providing services for more than three years when an annexation occurs and when the City intends to provide such services; and

WHEREAS, in March 2001, Brentwood Disposal was formally notified of the City of Brentwood's Central Annexation (LAFC 00 25); and

WHEREAS, in accordance with PRC 49520, Brentwood Disposal agreed to transfer such Services to the City by March 2006; and

WHEREAS, by mutual agreement of the City of Brentwood and Brentwood Disposal, solid waste collection services in two subdivisions, Rose Garden and Sterling Preserve II, were transferred to City on June 1, 2005.

NOW, THEREFORE, BE IT RESOLVED that the City Manager has the authorization to execute an agreement with Garaventa Enterprises, dba Brentwood Disposal for the transfer of solid waste services in the Central Annexation area for the Rose Garden and Sterling Preserve II subdivisions.
