Subject/Title: Adopt a Resolution approving a Reimbursement Agreement with Brentwood Sand Creek Partners, LLC, Vesting Tentative Subdivision Map No. 8788, for costs associated with Master Plan Facility Improvements.

RECOMMENDATION
Adopt a Resolution approving a Reimbursement Agreement with Brentwood Sand Creek Partners, LLC, Tentative Subdivision Map No. 8788, consisting of 311 lots, located south of Grant Street and east of the Union Pacific Railroad, on both sides of the O’Hara Avenue extension for Master Plan Facility Improvements.

PREVIOUS ACTION
On April 12, 1994, City Council adopted Resolution No. 94-63, which established a standard Reimbursement Agreement for Master Plan Facility Improvements.

On March 2, 2004, Planning Commission of the City of Brentwood adopted Planning Commission Resolution No. 04-10, approving Vesting Tentative Subdivision Map (VSTM) No. 8788, with conditions.

On May 3, 2005, Planning Commission amended Resolution No. 04-10, to modify eleven of the conditions of approval for Vesting Tentative Subdivision Map No. 8788.

BACKGROUND
Brentwood Sand Creek Partners, LLC, VSTM No. 8788, is located south of Grant Street and east of the Union Pacific Railroad. The Conditions of Approval for VSTM No. 8788 required the Developer to construct certain excess capacity and off-site Master Plan Facility Improvements. When a developer constructs improvements that provide capacity in excess of the needs of their development, the State Subdivision Map Act requires that the City enter into a reimbursement agreement with the developer.

The Master Plan Improvements that qualify for reimbursement are park design, construction, land, EBMUD trail, landscaping, trail along railroad, recycled water line in Grant Street, off-site sewer laterals for existing properties, 20” & 24” water in Grant Street and O’Hara Avenue and oversized and off-site road construction on O’Hara Avenue, Adams Lane and Grant Street. Brentwood Unified School District will reimburse the City for their share of Adams Lane frontage improvements, joint trench and 8” sewer extension. The Developer submitted an original reimbursement request of $9,291,137.22 for reimbursement. A careful review by staff of the Conditions of Approval and plans resulted in an agreement for $6,712,052.44. The City Engineer may modify the agreement if final quantities or items change. The City Engineer has reviewed this agreement.

FISCAL IMPACT
Water, wastewater, roadway, parks and trails facility fee credits will be given. The school will reimburse the City for their share of Adams Lane frontage improvements, per the attached letter.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING A REIMBURSEMENT AGREEMENT WITH BRENTWOOD SAND CREEK PARTNERS, LLC, VESTING TENTATIVE SUBDIVISION MAP NO. 8788, LOCATED SOUTH OF GRANT STREET AND EAST OF THE UNION PACIFIC RAILROAD, FOR COSTS ASSOCIATED WITH MASTER PLAN FACILITY IMPROVEMENTS.

WHEREAS, on April 12, 1994, by Resolution No. 94-63, City Council approved a standard Reimbursement Agreement for Master Plan Facility Improvements; and

WHEREAS, on March 2, 2004, Planning Commission of the City of Brentwood adopted Planning Commission Resolution No. 04-10, approving Vesting Tentative Subdivision Map No. 8788, with conditions to construct certain Master Plan Facility Improvements; and

WHEREAS, on May 3, 2005, Planning Commission amended Resolution No. 04-10 to modify eleven of the conditions of approval for Vesting Tentative Subdivision Map No. 8788; and

WHEREAS, certain Master Plan Facility Improvements are reimbursable under the City of Brentwood Master Plan Facility Fee Program; and

WHEREAS, the Developer will construct the Master Plan Facility Improvements eligible for reimbursement.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood does hereby approve a Reimbursement Agreement with Brentwood Sand Creek Partners, LLC for Master Plan Improvements to be constructed in conjunction with Vesting Tentative Subdivision Map No. 8788, as shown on the Reimbursement Agreement Site Map.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 26th day of July 2005 by the following vote:
