Adopt a Resolution accepting public improvements for maintenance, accepting
the Subdivision Maintenance Bond and releasing the Subdivision Improvement
Securities for Subdivision No. 8491, Deer Ridge Country Club, Village H-1-A
Unit 1, developed by Lafferty Homes, located south of Balfour Road and west
of Foothill Drive.
On January 19, 1993, by Resolution No. 93-2, the Planning Commission
approved Tentative Subdivision Map No. 7690, with conditions.
On October 14, 2003, by an Informational Report, City Council was notified
of the City Manager’s approval of the Final Map and Subdivision Improvement
Agreement for Subdivision No. 8491 and acceptance of improvement securities.
This subdivision, located south of Balfour Road and west of Foothill Drive,
contains 25 single-family residential lots. All public improvements required
by the conditions of approval for this subdivision have been constructed and
inspected for conformance with the approved improvement plans including
sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber
optics. Lafferty Homes has provided a Maintenance Bond to cover the
twelve-month warranty period for the improvements.
As required by the conditions of approval and shown on the improvement
plans, the Developer has installed the following improvement quantities: 332
LF of 8” sewer lines, 1,069 LF of 8” water lines, 803 LF of 18” storm drain
lines, 2,122 LF of curb and gutter, 2,228 LF of 5’ wide sidewalk, 1,142 LF
of pavement, 6 streetlights and 3,183 LF of joint trench including fiber
optic conduit. The necessary right-of-way offers of dedication and easements
required for maintenance of the public improvements were offered to the City
and accepted as a part of the final map. With the improvements now installed
to support the new lots, it is the appropriate time to accept the
improvements and begin the warranty period.
Upon acceptance of improvements, the City will incur annual costs in the
amount of approximately $6,500 associated with necessary maintenance of
streets, landscaping and utilities. Routine roadway maintenance will be
funded by the General Fund and Measure “C” gas tax, with sewer and water
maintenance funded through their respective enterprise funds. Landscaping
and Lighting Assessment District (LLD) No. 99-5 has been formed for this
subdivision and will be responsible for the street lighting and landscape

PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE
BONDS AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR SUBDIVISION
NO. 8491, DEER RIDGE COUNTRY CLUB, VILLAGE H-1-A, UNIT 1, DEVELOPED BY
LAFFERTY HOMES, LOCATED SOUTH OF BALFOUR ROAD AND WEST OF FOOTHILL DRIVE.
WHEREAS, on January 19, 1993, by Resolution No. 93-2, the Planning
Commission approved Tentative Subdivision Map No. 7690, with conditions; and
WHEREAS, on October 14, 2003, by an Informational Report, City Council was
notified of the City Manager’s approval of the Final Map and Subdivision
Improvement Agreement for Subdivision No. 8491 and acceptance of improvement
WHEREAS, right-of-way offers of dedication and easements required for public
improvements were offered upon the Final Map and accepted by the City at
final map approval; and
WHEREAS, the required public improvements have been completed and are in
conformance with the approved improvement plans.
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood
that the public improvements are hereby accepted for maintenance.
BE IT FURTHER RESOLVED that the Maintenance Bond to guarantee against
defects in material and workmanship for a period of twelve months is hereby
BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds
will be released within sixty (60) days of the passage of this Resolution.
BE IT FURTHER RESOLVED that the City Council of the City of Brentwood
directs the City Clerk to file this Resolution with the Recorder of Contra
