Subject/Title: Adopt a Resolution authorizing City staff to prepare and submit an Out of Agency Service Request to LAFCO for sewer and water service for the property owners of 8011 Lone Tree Way on their behalf.

RECOMMENDATION
Adopt a resolution authorizing City staff to prepare an Out of Agency Service Application to the Local Agency Formation Commission (LAFCO) on behalf of the property owner of 8011 Lone Tree Way for sewer and water service.

PREVIOUS ACTION
At the Council meeting of April 12, 2005, the property owner, Mark Sutter, requested Council’s approval of a LAFCO Out of Agency Service Agreement for sewer and water service due to the property’s failing septic system. City Engineer Bailey Grewal suggested staff return with more information.

BACKGROUND
This property is outside the City’s current City limits and is located at the southeast corner of Lone Tree Way and Anderson Lane. Annexation of this property into the City is anticipated to be scheduled for LAFCO approval in the near future.

The County Department of Health Services has inspected the facility and determined that the existing septic system is beyond repair and in need of replacement. Due to the unusable septic system, the residence is currently uninhabitable and the property owners have had to temporarily vacate the residence. Water and sewer lines are in the vicinity of the property and were installed by the City as a part of the Lone Tree Way Sewer and Water Capital Improvement Program Project. With the proximity of sanitary sewer within 300-feet of the property, County Health Services direction upon inspection was to connect to sewer service and abandon the septic system. However, connecting into the City system requires LAFCO approval due to the property residing outside the City limits. There is sufficient capacity to serve this residence in the City’s water and wastewater system should City Council direct staff to proceed and LAFCO approves the Out of Agency Service Agreement.

FISCAL IMPACT
There is no fiscal impact to the City as the property owner is responsible for all City fees (connection, inspection, staff time and monthly water and sewer charges) as well as the associated LAFCO application fee of $2,000 (as of October 1, 2003) and construction costs should LAFCO approve this Out of Agency Service Request.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY ENGINEER OR HIS DESIGNEE TO PREPARE AND SUBMIT AN OUT OF AGENCY SERVICE REQUEST TO THE LOCAL AGENCY FORMATION COMMISSION (LAFCO) FOR CITY SEWER AND WATER SERVICE TO 8011 LONE TREE WAY.


WHEREAS, the City of Brentwood provides sewer and water service to properties within the City limits of Brentwood; and

WHEREAS, for the City of Brentwood to provide sewer and water service to a property outside it’s City limits an Out of Agency Service Request must be approved by the Local Agency Formation Commission (LAFCO); and

WHEREAS, a property owner located at 8011 Lone Tree Way has a failing septic system that has been inspected by Contra Costa County Health Services and directed to connect to sanitary sewer service; and

WHEREAS, the property owner has requested the City of Brentwood submit and Out of Agency Service Request to the Local Agency Formation Commission (LAFCO) for sewer and water service; and

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the City Engineer or his designee is authorized to prepare and submit an Out of Agency Service Request to the Local Agency Formation Commission (LAFCO) for City sewer and water service to 8011 Lone Tree Way.
