CITY COUNCIL AGENDA ITEM NO. 8

Subject/Title: Adopt a Resolution authorizing staff to temporarily close Lone Oak Road, Lone Oak Court and Saddle Creek Court for approximately sixty (60) working days and temporarily close Grant Street for approximately ten (10) working days.

RECOMMENDATION
Adopt a Resolution authorizing staff to temporarily close Lone Oak Road, Lone Oak Court and Saddle Creek Court for approximately sixty (60) working days for construction of sewer and water infrastructure for the surrounding neighborhood and temporarily close Grant Street for approximately ten (10) working days to complete the construction of Grant Street, prior to the opening of Marsh Creek Elementary School.

PREVIOUS ACTION
On March 2, 2004, by Planning Commission Resolution No. 04-10, the Planning Commission approved Vesting Tentative Subdivision Map No. 8788, with conditions.

On May 3, 2005, Planning Commission amended Resolution No. 04-10 by modifying various conditions of approval for Vesting Tentative Subdivision Map No. 8788.

BACKGROUND
Lennar Homes, as part of their conditions of approval for Subdivision No. 8788, is required to construct sewer and water lines on Lone Oak Road, Lone Oak Court, Gracie Lane and Saddle Creek Court. These improvements will provide property owners along these roads the opportunity to tie into the City sewer and water systems.

In order to construct these improvements, especially the sewer line being up to 14 feet deep in some areas, the majority of the roadway will be demolished in order to install the utilities. Since the existing roadways vary from 17 to 20 feet wide, as well as established drainage swales in many areas running parallel with the roadway, there is not enough room to detour cars around the construction zone.

Fortunately, with the development of new roads within the new subdivision built by Lennar Homes, there are alternate routes for the local traffic to allow access and egress to their properties during the roadway closure. The attached detour map shows alternate access points such as Gracie Lane which can take access off of new Adams Lane, Lone Oak Road which can take access off of Caper Drive and O’Hara Avenue. The only street without an additional access point is Saddle Creek Court, but with a 60 foot roadway dedication and only 18 feet of existing paved roadway, traffic can be detoured around the construction zone. Fortunately, the drainage swales in this section of roadway are small and can be easily filled temporarily to detour residential traffic around the construction zone.

This closure will also help facilitate the final pavement tie in connection at the intersection of Grant Street and Lone Oak Road. At this intersection, the roadway crosses the EBMUD aqueducts and the City is required to install a concrete protective slab to protect these aqueducts. The roadway will need to be closed to install this concrete section and allow the proper cure time for the concrete before traffic is allowed to drive on the new roadway.

The utility work on Lone Oak Road, Lone Oak Court, Gracie Lane and Saddle Creek Court and the roadway improvements at the intersection of Grant Street and Lone Oak Road are tentatively scheduled to begin at the end of July or early August 2005. The Developer will work with the City to notify the citizens who will be impacted by the road closure. The means of notification will include mailing notices and affixing door hangers to residents and updating the City's Traffic Alert section of the web site.

Lennar Homes is also requesting to close Grant Street, from Cesar Chavez Drive to Lone Oak Road, to expedite the reconstruction of Grant Street in order to open the roadway in time for the Marsh Creek Elementary School opening on August 1, 2005. Since there is only one access for the Lone Oak and Gracie Lane residents, they will be rerouted through the connection at Lone Oak and O’Hara Avenue and also at Caper Drive and O’Hara Avenue, as shown on the attached map. This work will begin as soon as possible once all residents and all emergency service providers have been notified.

The detour plan for these improvements will be reviewed and approved by the City Engineer prior to construction. The City Engineer will have the discretion of determining when to allow Lennar Homes to proceed with the work and notifying the emergency service providers such as Police and Fire Departments of this closure.

FISCAL IMPACT
The funding for the sewer and water improvements is through a reimbursement agreement between the Developer and the City and funded by the Redevelopment Agency. The funding for the Grant Street improvements is through a Reimbursement Agreement between the Developer and the City and also by Facility Fees.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING STAFF TO TEMPORARILY CLOSE LONE OAK ROAD, LONE OAK COURT AND SADDLE CREEK COURT FOR APPROXIMATELY SIXTY (60) WORKING DAYS FOR CONSTRUCTION OF SEWER AND WATER INFRASTRUCTURE TO THE SURROUNDING NEIGHBORHOOD AND ROADWAY IMPROVEMENTS AT THE INTERSECTION OF GRANT STREET AND LONE OAK ROAD AND TEMPORARILY CLOSE GRANT STREET FOR APPROXIMATELY TEN (10) WORKING DAYS TO COMPLETE THE CONSTRUCTION OF GRANT STREET, PRIOR TO THE OPENING OF MARSH CREEK ELEMENTARY SCHOOL.

WHEREAS, Lennar Homes, as part of their conditions of approval for project development, is required to construct sewer and water lines on Lone Oak Road, Lone Oak Court, Gracie Lane and Saddle Creek Court; and

WHEREAS, in order to construct these improvements, the majority of the roadway will be demolished in order to install the utilities; and

WHEREAS, with the development of new roads within the new subdivision built by Lennar Homes, there are alternate routes for the local traffic to allow access and egress to their properties during the roadway closure; and

WHEREAS, these improvements will provide property owners along these roads the choice to tie into the City system and potentially remove their aging systems and wells; and

WHEREAS, the closure of Grant Street is necessary to complete the roadway reconstruction from Cesar Chavez Drive to Lone Oak Road and to open the new Grant Street roadway prior to the Marsh Creek Elementary School opening on August 1, 2005.

WHEREAS, the Developer will work with the City to notify the citizens and service providers who are the most impacted by providing at least five (5) days prior to the road closure; and

WHEREAS, the detour plan for these improvements will be reviewed and approved by the City Engineer prior to construction.

NOW, THEREFORE BE IT RESOLVED that the City Council of the City of Brentwood authorize staff to temporarily close Lone Oak Road, Lone Oak Court and Saddle Creek Court for approximately sixty (60) working days for construction of sewer and water infrastructure to surrounding neighborhood.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood authorize staff to temporarily close Grant Street from Cesar Chavez Drive to Lone Oak Road for approximately ten (10) working days for the reconstruction of Grant Street.
