Subject/Title: Adopt a Resolution authorizing the execution of a Quitclaim Deed for a portion of Parcel “B” of Subdivision No. 8829 to Western Pacific Housing, Inc.

RECOMMENDATION
Adopt a Resolution authorizing the Mayor, City Manager and City Clerk or their designees to execute a Quitclaim Deed to Western Pacific Housing, Inc. for a portion of Parcel “B”, as shown on that certain Final Map entitled “Subdivision No. 8829”, filed November 30, 2004 in Book 471 of Maps, Page 33, in the Office of the County Recorder of Contra Costa County and hereby conveying any interest the City may have in that portion of said parcel to Western Pacific Housing, Inc. and any other documents necessary to complete the transaction.

PREVIOUS ACTION
On November 9, 2004, by Ordinance No. 759, City Manager approved the Final Map of Subdivision No. 8829, and accepted the offers of public dedication, which included Parcel “B”.

BACKGROUND
Western Pacific Housing, Subdivision No. 8829, is located south of Balfour Road and west of Concord Avenue on the south side of Spyglass Drive. Parcel “B”, as shown on the attached Quitclaim Deed, was dedicated to the City of Brentwood for public use by Western Pacific Homes as part of Subdivision No. 8829 Final Map.

Lot 23 of Subdivision No. 8490, Deer Ridge Country Club Village G-3 and Parcel “B” of Subdivision No. 8829, Deer Ridge Country Club Village G-2, are adjacent to one another on their respective westerly and easterly property lines. Parcel “B” (containing approximately 56,716 s.f. more or less) was dedicated on the final map to the City by the developer of Subdivision No. 8829 for open space, and is now a City owned parcel. During installation of the rear yard fence of Lot 23, it was determined that a lot line adjustment was necessary to place the rear yard fence at a location that was mutually beneficial for proper drainage of Lot 23 and Parcel “B” now owned by the City. This lot line adjustment will allow Lot 23 drainage to be collected and conveyed within its own lot and Parcel “B” will have its own drainage system. The developer has requested the City approve a Lot Line Adjustment and quitclaim a portion of Parcel “B” (997 s.f. more or less), so that the rear yard fence can be placed at a location on the respective properties that will allow each property to have its own drainage system.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE MAYOR, CITY MANAGER AND CITY CLERK OR THEIR DESIGNEES TO EXECUTE A QUITCLAIM DEED TO WESTERN PACIFIC HOUSING, INC. FOR A PORTION OF PARCEL “B”, AS SHOWN ON THAT CERTAIN FINAL MAP ENTITLED “SUBDIVISION NO. 8829”, FILED NOVEMBER 30, 2004 IN BOOK 471 OF MAPS, PAGE 33, IN THE OFFICE OF THE COUNTY RECORDER OF CONTRA COSTA COUNTY AND HEREBY CONVEYING ANY INTEREST THE CITY MAY HAVE IN THAT PORTION OF SAID PARCEL TO WESTERN PACIFIC HOUSING, INC. AND ANY OTHER DOCUMENTS NECESSARY TO COMPLETE THE TRANSACTION.

WHEREAS, on November 9, 2004, by Ordinance No. 759, City Manager approved the Final Map of Subdivision No. 8829, and accepted the offers of public dedication, which included Parcel “B”; and

WHEREAS, the City Council finds that a portion of Parcel “B” is required to place the rear yard fence of Lot 23, Subdivision 8490 at a location that is mutually beneficial for proper drainage of both properties; and

WHEREAS, Western Pacific Housing, Inc., original subdivider of both subdivisions, has requested a Lot Line Adjustment and conveyance of a portion of Parcel “B” of Subdivision No. 8829 owned by the City.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that a Lot Line Adjustment is approved and authorizes the Mayor, City Manager and City Clerk or their designees to execute a Quitclaim Deed to Western Pacific Housing, Inc. for a portion of Parcel “B”, as shown on that certain Final Map entitled “Subdivision No. 8829”, filed November 30, 2004 in Book 471 of Maps, Page 33, in the Office of the County Recorder of Contra Costa County and hereby conveying any interest the City may have in that portion of said parcel to Western Pacific Housing, Inc. and any other documents necessary to complete the transaction.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 12th day of July 2005 by the following vote:
