Subject/Title: Adopt a Resolution authorizing the City Manager to execute a contract amendment with Concept Design Company for construction management services for the CIP Project No. 542-5402, Solid Waste Transfer Station Improvements Phase III, for a contract amendment amount of $370,426, plus a 10% project contingency.

RECOMMENDATION
Adopt a Resolution authorizing the City Manager to execute a contract amendment with Concept Design Company for construction management services for the CIP Project No. 542-5402, Solid Waste Transfer Station Improvements Phase III, for an amendment amount of $370,426 plus 10% contingency for a total contract amendment amount of $407,468.60.

PREVIOUS ACTION
On May 25, 2004, by Resolution No. 2004-113, City Council approved the 2004/09 CIP Program that includes this project as part of the program.

On January 25, 2005, by Resolution No. 2005-20, City Council approved a contract with Carlton Engineering for schematic design work.

BACKGROUND
In a continuing effort to improve the operational efficiency of the City’s Solid Waste Transfer Station and to improve our ability to allow for limited public access, staff has been working to make significant changes to the site. Most notably, the operation will move under roof, an aboveground loading process will be constructed and we will expand the footprint of the dump pad to accommodate the expected growth to build out for the City.

On October 4, 2004, staff entered into an agreement with Concept Design Company for preliminary review and conceptual design of a municipal transfer station facility in the amount of $25,000. On March 31, 2005, staff amended the contract for continued design consultation in the amount of $20,460 to assist with the completion of the schematic design effort. This work has been completed and staff is now preparing to move into the design development phase and pre-construction phase of the project and it is staff’s recommendation to approve the second amendment for pre-construction and construction management services with Concept Design Company.

FISCAL IMPACT
The funding for this project includes the original contract amount of $45,460, the requested amendment amount of $370,426 plus a 10% contingency of $37,042.60, for a total amendment of $407,468.60 and a total contract amount not to exceed $452,928.60. No additional funding sources are necessary. This is a one time cost as it is for construction management services. No revenue offsets are anticipated.

RESOLUTION NO.

ADOPT A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT AMENDMENT WITH CONCEPT DESIGN COMPANY FOR CONSTRUCTION MANAGEMENT SERVICES FOR THE CIP PROJECT NO. 542-5402, SOLID WASTE TRANSFER STATION IMPROVEMENTS PHASE III, FOR AN AMENDMENT AMOUNT OF $370,426, PLUS APPROVAL OF A 10% CONTINGENCY.

WHEREAS, on May 25, 2004, by Resolution 2004-113, City Council approved the 2004/09 CIP Program that includes this project as part of the program; and

WHEREAS, the City’s Solid Waste Division must expand their Solid Waste Transfer Station’s ability to safely and efficiently process the expected increased volumes of material due to the City’s growth; and

WHEREAS, on January 25, 2005, by Resolution No. 2005-20, City Council approved a contract with Carlton Engineering for schematic design work; and

WHEREAS, staff continues to work towards preparing design and construction documents as necessary for the transfer station facility improvements; and

WHEREAS, in order to continue with the project, staff recommends approving an amendment with the project’s design and construction management services firm, Concept Design Company.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, authorize the City Manager or his or her designee to execute a contract amendment with Concept Design Company for construction management services for the CIP Project No. 542-5402, Solid Waste Transfer Station Improvements Phase III, for a contract amendment amount of $370,426, plus a 10% project contingency.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 12th day of July 2005 by the following vote:

AMENDMENT TWO
TO
AGREEMENT

This Amendment is entered into on July 12, 2005 by and between the City of Brentwood and Concept Design Company.

WHEREAS, on March 31, 2005, the City of Brentwood amended the original contract agreement to include additional schematic design services of Concept Design Company.

WHEREAS, on the 4th Day of October 2004, the City of Brentwood entered into a contract with Concept Design Company, to obtain preliminary review and conceptual design of a Municipal Transfer Station Facility Project No. 542-5402, Solid Waste Transfer Station Improvements Phase III.

NOW, THEREFORE, IT IS AGREED as follows:

1. Section 4, of the contract entitled Term shall include the attached scope of work which includes design and construction services.
2. Section 5, of the contract, entitled Payment is amended to increase the contract amount to $415,886.
3. All other terms remain unchanged.
