Subject/Title: Reciting the Facts of the June 7, 2005 Special Municipal Election

RECOMMENDATION
Approve the proposed Resolution reciting the facts of the June 7, 2005 Special Municipal Election.

PREVIOUS ACTION
At the meeting of February 8, 2005, Council Member Petrovich resigned creating a vacancy with a term ending 2008.

At the meeting of February 8, 2005, the City Council:

Adopted Resolution No. 2005-36 calling and giving notice of the holding of a special municipal election to be held on Tuesday, June 7, 2005, for the election of a Council Member to fill a vacancy as required by the provisions of the laws of the State of California relating to general law cities.

Adopted Resolution No. 2005-37 requesting the Board of Supervisors of the County of Contra Costa to conduct a Special Municipal Election to be held on June 7, 2005.

Adopted Resolution No. 2005-38 adopting regulations for candidates for elective office pertaining to Candidates statements submitted to the voters at an election.

BACKGROUND
Pursuant to §10262 of the Election Code, the City Council shall adopt a Resolution certifying the results of the election, after which the newly elected Council Member will take the Oath of Office and be seated.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD, CALIFORNIA, RECITING THE FACTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON JUNE 7, 2005 DECLARING THE RESULT AND SUCH OTHER MATTERS AS PROVIDED BY LAW

WHEREAS, a vacancy with a term ending 2008 was created by Council Member Petrovich resigning at the City Council meeting of February 8, 2005; and

WHEREAS, City Council adopted Resolution No. 2005-36 calling and giving notice of the holding of a special municipal election to be held on Tuesday, June 7, 2005, for the election of a Council Member to fill a vacancy as required by the provisions of the laws of the State of California relating to general law cities; and

WHEREAS, City Council adopted Resolution No. 2005-37 requesting the Board of Supervisors of the County of Contra Costa to conduct a Special Municipal Election to be held on June 7, 2005; and

WHEREAS, City Council adopted Resolution No. 2005-38 adopting regulations for candidates for elective office pertaining to Candidates statements submitted to the voters at an election; and

WHEREAS, a Special Municipal Election was held and conducted in the City of Brentwood, California, Tuesday, June 7, 2005, as required by law; and

WHEREAS, notice of the election was given in time, form and manner as provided by law; that voting precincts were properly established; that election officers were appointed and that in all respects the election was held and conducted and the votes were cast, received and canvassed and the returns made and declared in time, form and manner as required by the provisions of the Elections Code of the State of California for the holding of elections in general law cities; and

WHEREAS, pursuant to Resolution No. 2005-37 adopted February 8, 2005, the County Election Department canvassed the returns of the election and has certified the results to this City Council, the results are received, attached and made a part hereof as “Exhibit A”.

NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE BRENTWOOD DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS:

SECTION 1. That the whole number of ballots cast in the precincts except absent voter ballots was 1,339, that the whole number of absent voter ballots cast in the City was 2,530, making a total of 3,869 ballots cast in the City.

SECTION 2. That the names of the persons voted for at the election for Members of the City Council were as follows:

Charles Handwork
Chris Becnel
Bob Brockman
Richard G. Bates, Jr.

SECTION 3. That the number of votes given at each precinct and the number of votes given in the City to each of the persons above named for the respective offices for which the persons were candidates is as listed in “Exhibit A” attached.

SECTION 4. That the City Council does declare and determine that:

Bob Brockman was elected as Member of the City Council of said City for the remainder of the term ending in November 2008 to fill the vacancy of resigned Council Member Petrovich.

SECTION 5. That the City Clerk shall enter on the records of the City Council of the City of Brentwood, a statement of the result of the election, showing:

a. The whole number of votes cast in the City;
b. The names of the persons voted for;
c. For what office each person was voted for;
d. The number of votes given at each precinct to each person;
e. The number of votes in the City given to each person.

SECTION 6. That the City Clerk shall immediately make and deliver to the person so elected a Certificate of Election signed by the City Clerk and authenticated; that the City Clerk shall also administer to the person elected the Oath of Office prescribed in the Constitution of the State of California and shall have him subscribe to it and file it in the office of the City Clerk. The person so elected shall then be inducted into the respective office to which he has been elected.

SECTION 7. That the City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting held on the 28th day of June, 2005 by the following vote:
