Subject/Title: Adopt a Resolution accepting improvements constructed by DeNova Homes, as a part of the Sunset Road Realignment, CIP Project No. 336-012 and direct the City Clerk to file a Notice of Completion with the County Recorder.

RECOMMENDATION
Adopt a Resolution accepting improvements constructed by DeNova Homes, as a part of the Sunset Road Realignment, CIP Project No. 336-012, between Tresch Road and Brentwood Boulevard and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On January 8, 2002, by Resolution No. 2437, the City Council approved the Reimbursement Agreement with DeNova Homes for repayment of Sunset Road Realignment off-site improvements.

On May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included the Sunset Road Realignment, CIP Project No. 336-3012.

BACKGROUND
The Sunset Road Realignment project realigned Sunset Road to intersect Brentwood Boulevard at Grant Street, instead of the old location adjacent to Marsh Creek. The project improved traffic circulation and public safety by realigning the roadway to a signalized intersection at Grant Street.

The City Council approved the reimbursement agreement with DeNova Homes on December 17, 2001, for the construction of the Sunset Road Realignment roadway improvements. At this time the Sunset Road Realignment improvements are complete and operational and have been inspected for conformance with the approved improvement plans.

The following is the scope of improvements constructed; these listed improvements will be maintained by the City upon acceptance:

 Approximate 1,500 LF 2-lane roadway including curb and gutter, sidewalk, signing and striping and landscaped parkway, street lights, various diameter storm drain lines ranging from 18” to 24”, inlets and manholes.
 500 LF Brentwood Boulevard roadway widening on the east side from Havenwood Avenue to Sunset Court.
 450 LF one way travel lane road, McHenry Way connecting the Homecoming subdivision to Sunset Road.
 120 foot length free span precast concrete girder bridge across Marsh Creek.
 Concrete protective slabs under roadway across EBMUD aqueducts at the Sunset/Hwy 4 and Jane Way crossings.
 1,500 LF 10 foot wide trail extension from Brentwood Boulevard along EBMUD corridor to Elkins Way.
 Signal modifications at existing Brentwood Boulevard Grant Street intersection for the new “Sunset Road” leg of the intersection.
 1,000 LF of waterline extension to Brentwood Boulevard including valves and fire hydrants.
 1,800 LF of non-potable waterline from Elkins Way to Brentwood Boulevard.
 400 LF of fiber optic conduit extension to Brentwood Boulevard water plant.

FISCAL IMPACT
The total project cost and reimbursement to DeNova Homes is $3,035,772 as outlined in the Reimbursement Agreement with DeNova Homes that was executed on January 8, 2002. The final progress payment in the amount of $324,274.08 is being processed. The total CIP construction and contract administration budget for this work is $3,048,000. Therefore, the project was completed within the allocated budget. Routine roadway maintenance will be funded by the General Fund and Measure “C”, gas tax, with water maintenance funded through the enterprise fund. Various Landscaping and Lighting Assessment Districts have been formed through adjacent developments and will be responsible for the street lighting and landscape maintenance.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING IMPROVEMENTS CONSTRUCTED BY DENOVA HOMES, AS A PART OF THE SUNSET ROAD REALIGNMENT, CIP PROJECT NO. 336-012, BETWEEN TRESCH ROAD AND BRENTWOOD BOULEVARD AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, on January 8, 2002, by Resolution No. 2437, the City Council approved the Reimbursement Agreement with DeNova Homes for repayment of Sunset Road Realignment off-site improvements; and

WHEREAS, on May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included the Sunset Road Realignment, CIP Project No. 336-3012.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the improvements constructed by DeNova Homes, as a part of the Sunset Road Realignment, CIP Project No. 336-012, between Tresch Road and Brentwood Boulevard are hereby accepted.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood direct the City Clerk to file a Notice of Completion with the County Recorder.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did on the 8th day of January 2002 enter into an agreement with DeNova Homes, for the Sunset Road Realignment, CIP Project No. 336-3012.

The work described in the agreement was to furnish all material, labor, and equipment necessary to complete said project.

On the 28th day of June 2005, said contract as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
