Subject/Title: Adopt a Resolution accepting Improvements for Inverness at Brentwood Lake, Brookfield Homes Unit 9, Subdivision No. 8375.

RECOMMENDATION
Adopt a Resolution accepting the right-of-way offers of dedication in-fee; accepting easements, abutter’s rights and sub-surface mineral and water rights as shown on the Final Map; accepting all public improvements for maintenance; accepting the Subdivision Maintenance Bond and releasing the Subdivision Improvement Securities for Inverness at Brentwood Lake, Brookfield Homes Unit 9, Subdivision No. 8375, located north of Balfour Road and west of East Country Club Drive.

PREVIOUS ACTION
On March 9, 1993, by Resolution No. 93-27, the Planning Commission of the City of Brentwood, approved Tentative Subdivision Map No. 7705 with conditions.

On January 9, 2001, by Resolution No. 2217, the City Council approved Final Map Subdivision No. 8375, accepted improvement securities and approved the Subdivision Improvement Agreement.

BACKGROUND
This subdivision, located west of East Country Club Drive and north of Balfour Road, is Phase 9 of Brookfield Home’s Shadow Lakes project and contains 115 single-family residential lots. All public improvements required by the conditions of approval for this subdivision have been constructed and inspected for conformance with the approved improvement plans including sewer, water and storm drain lines, sidewalk, paving, streetlights and fiber optics. Brookfield Homes has provided a Maintenance Bond to cover the twelve-month warranty period for the improvements.

As required by the conditions of approval and shown on the improvement plans, the Developer has installed the following improvement quantities: 3,420 LF of 8” sewer lines, 6,960 LF of various diameter waterlines, 3,170 LF of 18” storm drain lines, 14,010 LF of curb and gutter, 14,118 LF of 5’ wide sidewalk, 14,412.88 LF of pavement, 7,000 LF of joint trench including fiber optic conduit and 37 streetlights.

When the Final Map was approved by City Council, the right-of-way offers of dedication were accepted subject to acceptance of improvements. The improvements are now installed to support the new lots; therefore, it is the appropriate time to accept the improvements, rights-of-way and easements as offered on the Final Map.

FISCAL IMPACT
Upon acceptance of improvements the City will incur annual costs in the amount of approximately $17,000, associated with necessary maintenance of streets, landscaping and utilities. Routine roadway maintenance will be funded by the General Fund and Measure “C” gas tax with sewer and water maintenance funded through their respective enterprise funds. Landscaping and Lighting Assessment District (LLD) No. 97-1 has been formed for this subdivision and will be responsible for the street lighting and landscape maintenance.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE RIGHT-OF-WAY OFFERS OF DEDICATION IN-FEE; ACCEPTING EASEMENTS, ABUTTER’S RIGHTS AND SUB-SURFACE MINERAL AND WATER RIGHTS AS SHOWN ON THE FINAL MAP; ACCEPTING ALL PUBLIC IMPROVEMENTS FOR MAINTENANCE; ACCEPTING THE SUBDIVISION MAINTENANCE BOND AND RELEASING THE SUBDIVISION IMPROVEMENT SECURITIES FOR INVERNESS AT BRENTWOOD LAKE, BROOKFIELD HOMES, SUBDIVISION NO. 8375, LOCATED NORTH OF BALFOUR ROAD AND WEST OF EAST COUNTRY CLUB DRIVE.


WHEREAS, on March 9, 1993, by Resolution No. 93-27, Planning Commission of the City of Brentwood, approved Tentative Subdivision Map No. 7705 with conditions; and

WHEREAS, on January 9, 2001, by Resolution No. 2217, City Council approved Final Map Subdivision No. 8375, accepted improvement securities and approved the Subdivision Improvement Agreement; and

WHEREAS, the required public improvements have been completed and constructed in substantial conformance with the approved improvement plans.

NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Brentwood that the public improvements are hereby accepted for maintenance, and all offers of dedication for rights-of-way, easements and parcels of land intended for public use as shown on the Final Map are also hereby accepted.

BE IT FURTHER RESOLVED that the Maintenance Bonds to guarantee against defects in material and workmanship for a period of twelve months are hereby accepted.

BE IT FURTHER RESOLVED that the Subdivision Performance and Payment Bonds will be released within sixty (60) days of the passage of this Resolution.

BE IT FURTHER RESOLVED that the City Council of the City of Brentwood directs the City Clerk to file this Resolution with the Recorder of Contra Costa County.
