Subject/Title: Adopt a Resolution approving the Purchase Agreement with Joan Lehmann for the Walnut Boulevard Widening, CIP Project No. 336-3056.

RECOMMENDATION
Adopt a Resolution approving an agreement for purchase of a fee parcel with Joan Lehmann, for a portion of real property identified as APN 012-100-007, generally located south of Indiana Avenue and on the west side of Walnut Boulevard, hereby accepting real property on behalf of the City, and authorizing the Mayor or City Manager and City Clerk or any of their designees to execute the agreement and such other documents as may be needed to complete the transaction including acceptance of the Deed.

PREVIOUS ACTION
On May 26, 1998, City Council approved an updated Master Agreement, Administering Agency-State Agreement for Federal Aid Projects No. 04-5300.

On June 27, 2000, City Council authorized the City Manager to sign a design contract with Harris & Associates for the design of Walnut Boulevard Widening, CIP Project No. 336-3056, from Balfour Road to Oak Street.

On March 13, 2001, by Resolution No. 2249, City Council authorized the City Manager to execute a Program Supplement Agreement No. 002-M to Administering Agency-State Agreement No. 04-5300 for reimbursement of costs for preliminary engineering for the Walnut Boulevard Widening, CIP Project No. 336-3056.

On May 24, 2005, by Resolution No. 2005-115, City Council adopted the 2005/06 – 2009/10 Capital Improvement Program that included the Walnut Boulevard Widening, CIP Project No. 336-3056.

BACKGROUND
Walnut Boulevard is our main gateway to the City from the south and carries the majority of commute traffic from East County to Tri-Valley and Silicon Valley for jobs. The widening of Walnut Boulevard will improve the northbound and southbound vehicular commute traffic to the City’s main commute arterial, Vasco Road, south of town. This project will also upgrade the storm drain, water and sewer systems in that vicinity. The project consists of 2,300 linear feet of widened street and asphalt concrete overlay, installation of curbs, gutters and sidewalk, plus installation of 2,300 linear feet of storm drain, sewer, water and fiber optic conduit systems. Also, construction of this project will induce development of properties between Walnut Boulevard and the Union Pacific Railroad, south of Oak Street.

The City was awarded a grant in the amount of $1,300,000 from the Federal Intermodal Surface Transportation Efficiency Act (ISTEA) program, but due to time constraints it was impossible to meet Federal requirements. The Metropolitan Transportation Commission (MTC) approved the City’s request to transfer $1,110,000 of these funds to the Brentwood Boulevard Widening Project, CIP Project No. 336-3054. The City is obligated, per signed agreement with the State of California, to perform this work prior to September 2007.

The acquisition of a portion of the Lehman property is just one of the acquisitions required to construct this project to its ultimate improvements.

FISCAL IMPACT
The acquisition costs for the right-of-way and temporary construction easement is $8,000 and has been budgeted through the current Walnut Boulevard Widening, CIP Project No. 336-3056 in the 2005/06-2009/2010 Capital Improvement Program adopted by the City Council on May 24, 2005.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD APPROVING AN AGREEMENT FOR PURCHASE OF A FEE PARCEL WITH JOAN LEHMANN, FOR A PORTION OF REAL PROPERTY IDENTIFIED AS APN 012-100-007, GENERALLY LOCATED SOUTH OF INDIANA AVENUE AND ON THE WEST SIDE OF WALNUT BOULEVARD, HEREBY ACCEPTING REAL PROPERTY ON BEHALF OF THE CITY AND AUTHORIZING THE MAYOR OR CITY MANAGER AND CITY CLERK OR ANY OF THEIR DESIGNEES TO EXECUTE THE AGREEMENT AND SUCH OTHER DOCUMENTS AS MAY BE NEEDED TO COMPLETE THE TRANSACTION INCLUDING ACCEPTANCE OF THE DEED.

WHEREAS, on May 25, 2004, by Resolution No. 2004-113, City Council adopted the 2004/05 – 2008/09 Capital Improvement Program that included the Walnut Boulevard Widening, CIP Project No. 336-3056; and

WHEREAS, real property generally located south of Indiana Avenue and on the west side of Walnut Boulevard in the City of Brentwood identified as APN 012-100-007, is needed for the Walnut Boulevard Widening, CIP Project No. 336-3056; and

WHEREAS, a purchase agreement between the City of Brentwood and the vested property owner has been developed and is necessary to transfer property.

NOW, THEREFORE BE IT RESOLVED, that the Mayor or the City Manager and City Clerk or any of their designees are authorized to execute the agreement and any related escrow documents including acceptance of the Grant Deed.

BE IT FURTHER RESOLVED, that the City of Brentwood hereby accepts the real property described in the Grant Deed.
