RECOMMENDATION
Approve a Resolution approving a Memorandum of Understanding between the California Department of Parks and Recreation and the City of Brentwood, and authorizing the City Manager to sign the MOU.

BACKGROUND
Since the very beginning, discussions of the Vineyards at Marsh Creek project and the establishment of the John Marsh House/Cowell Ranch State Park, it has been the intent of the City of Brentwood to enter into a formal working relationship with the California Department of Parks and Recreation. The purpose of working together is related to development of the trails and open space of the State Park, stabilization and restoration of the John Marsh House, and use of the John House property as a joint City/State park property. City staff has also been working with State Parks to take the lead in funding (through the Vineyards Development Agreement) and processing the General Plan necessary for the State Park property.

The result of this ongoing discussion is a final draft Memorandum of Understanding between the City of Brentwood and California Department of Parks and Recreation. This MOU is the framework for cooperation between the City and State Parks as it relates to the John Marsh House and Cowell Ranch, which together, make up the State Park property. The MOU specifically provides agreement for the City to move forward with the General Plan for the property and provides the general principles for working together on future aspects of the State Park. As specific projects are needed in the future, written agreements will be added to this MOU as addendums that will further define the relationship between the two parties.

Though State Parks has entered into MOUs with other agencies, this MOU with the City of Brentwood is the first of its kind where the State and a city, through a formal MOU, have formed a partnership and have agreed to work together to develop, restore, operate a unit of the State Park system to the benefit of the citizens of Brentwood and California. Once again, the City of Brentwood is working to form a partnership on behalf of our citizens that has not been done elsewhere in California.

Normally, agreements are brought forward to City Council after the other party has signed the agreement. As this agreement is with the California Department of Parks and Recreation, it requires first the signature of the District Superintendent of the State Parks Department, followed by the City Signature. Once these two signatures are approved, it will go to the Deputy Director of State Parks, and finally to the California Department of General Services.

FISCAL IMPACT
Approval of this agreement will allow the City to move forward with the General Plan of the State Park property, at a cost of “not to exceed $350,000”, which is funded by Blackhawk-Nunn through the developer agreement on the Vineyards at Marsh Creek property.

APPROVE A RESOLUTION APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CALIFORNIA DEPARTMENT OF PARKS AND RECREATION AND THE CITY OF BRENTWOOD AND AUTHORIZING THE CITY MANAGER TO SIGN THE MOU.

WHEREAS, the City of Brentwood and California Department of Parks and Recreation have mutual interests in the development and use of the John Marsh House/Cowell Ranch State Park property; and

WHEREAS, the City of Brentwood and California Department of Parks and Recreation wish to formalize a memorandum of understanding to establish a framework for a working relationship, and

WHEREAS, the City of Brentwood and California Department of Parks and Recreation have agreed to allow the City to take the lead in completion of the General Plan for the property to expedite the process; and

WHEREAS, this MOU between the City of Brentwood and California Department of Parks and Recreation is an innovative example of collaboration on behalf of the citizens of Brentwood and the State of California;

NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Brentwood approves a Resolution approving a Memorandum of Understanding between the California Department of Parks and Recreation and the City of Brentwood and authorizes the City Manager to sign the MOU.
