Subject/Title: Adopt a Resolution to amend and approve a Professional Services Agreement for William J. Silva, P.E., for Transportation Engineering Services.

RECOMMENDATION
Adopt a Resolution authorizing the City Manager to execute Amendment Two to the Professional Services Agreement with William J. Silva, P.E. to provide Transportation Engineering Services including: plan check, construction inspection, public services for transportation issues, etc., for the City of Brentwood on an as-needed basis in an amount not to exceed $50,000 through December 31, 2005.

PREVIOUS ACTION
A previous Professional Service Agreement for Transportation Engineering Services has been executed with William J. Silva, P.E. that is due to expire on June 30, 2005.

BACKGROUND
Due to lack of personnel in the Traffic and Transportation Division within the Engineering Department to adequately handle plan check, involving traffic signal design and operations and other work issues related to traffic and transportation, William J. Silva entered into a Professional Services Agreement with the City of Brentwood on August 19, 2004 to provide Transportation Engineering Services. The original agreement was set to expire on December 31, 2004 and Amendment One was processed to extend the contract to June 30, 2005. The Engineering Department is still without the proper personnel in the Traffic and Transportation Division and William Silva’s assistance will be required until we are able to fill the vacant Engineering Manager (Transportation) position, which is going out for recruitment. This contract amendment will bring the cost of these services over the $50,000 limit, which per the City’s Purchasing Policy requires City Council approval.

Staff has been very satisfied with William J. Silva’s previous professional work performance; therefore, staff recommends that the City Council amend and approve Amendment Two to the Professional Services Contract with William J. Silva, P.E. to perform various Engineering Transportation Services on an as-needed basis.

FISCAL IMPACT
The purchase orders up to $50,000 were executed by the City Manager as authorized by the City’s Purchasing Policy. The continuing additional services require this amendment to be approved by the City Council. The funds for this amendment in the amount of $50,000 to pay for the continuing services of William J. Silva, P.E. have been budgeted in the 2003/04 – 2004/05 Operating Budget and the upcoming 2005/06 – 2006/07 Operating Budget.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE CITY MANAGER THE AUTHORITY TO EXECUTE AMENDMENT TWO TO THE PROFESSIONAL SERVICES AGREEMENT WITH WILLIAM J. SILVA, P.E. TO PROVIDE TRANSPORTATION ENGINEERING SERVICES INCLUDING: PLAN CHECK, CONSTRUCTION INSPECTION, PUBLIC SERVICES FOR TRANSPORTATION ISSUES, ETC., FOR THE CITY OF BRENTWOOD ON AN AS-NEEDED BASIS IN AN AMOUNT NOT TO EXCEED $50,000 THROUGH DECEMBER 31, 2005.

WHEREAS, due to lack of personnel in the Traffic and Transportation Division within the Engineering Department to adequately handle plan check and other work issues, William J. Silva, P.E. to provide Transportation Engineering Services including: plan check, construction inspection, public services for transportation issues, etc., for the City of Brentwood on an as-needed basis.

PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at a regular meeting on the 14th day of June 2005 by the following vote:
