Subject/Title: Adopt a Resolution Authorizing the City Manager to execute an amendment to the current professional services agreement of $150,000 with McDonough Holland & Allen to an amount not to exceed $490,000 for Interim City Attorney Services through August 2005

RECOMMENDATION
Adopt a Resolution Authorizing the City Manager to execute an amendment to the current professional services agreement of $150,000 with McDonough Holland & Allen to an amount not to exceed $490,000 for Interim City Attorney Services through August 2005.

PREVIOUS ACTION
On June 8, 2004, the City Council approved Resolution No. 2004-132 Amending the 2004/05 Budget and Recommended adjustments.

On August 10, 2004, Council approved Resolution No. 2004-198 authorizing the City Manager to execute purchase orders or contracts for the not-to-exceed dollar amounts for various vendors for Fiscal Year 2004/05. McDonough, Holland & Allen was approved for an amount not-to-exceed $150,000.

BACKGROUND
In August 2004, when the City Council authorized the City Manager to execute a purchase order with McDonough, Holland & Allen for an amount not-to-exceed $150,000, the City Attorney vacancy was not anticipated. On March 1, 2005, the City retained the services of Thomas R. Curry, of McDonough, Holland & Allen, as the City’s Interim City Attorney.

The recruitment process is currently underway to fill the City Attorney position. It is anticipated that the vacancy will be filled by August 2005. Therefore, a contract amendment in the amount of $340,000 is needed for interim city attorney services through August 2005.

FISCAL IMPACT
The amendment to this professional services agreement would not require additional appropriations as it is budgeted.
