Subject/Title: Motion to direct staff to prepare for Planning Commission and City Council action a General Plan Amendment and Zoning Ordinance Amendment to establish a Condominium Conversion zoning ordinance and General Plan amendment.

RECOMMENDATION
Staff is recommending that the City Council make a motion directing staff to prepare a General Plan Amendment and Zoning Ordinance Amendment for Planning Commission and City Council action in order to establish criteria for the conversion of apartment units into for sale condominium units.

None.

BACKGROUND
Staff has been contacted by the developers of the Arbor Ridge Apartments regarding their desire to convert their project on Shady Willow Lane from “for rent” apartment units to “for sale” condominium units. The City does not currently have a Condominium Conversion Ordinance in place, nor does it have policies regarding condominium conversion within the Housing Element of the General Plan. As current zoning regulations differ for the development of apartments versus condominium units, staff is requesting that the Council direct staff to study and make recommendations for the Planning Commission and City Council for the adoption of a condominium conversion ordinance that would regulate this process as necessary and minimize potential adverse impacts. Potential adverse impacts include the reduction in adequate rental housing, lower percentage of affordable units, and lack of adequate parking for potential condominium units.

Staff is requesting the City Council pass a motion directing staff to research the condominium conversion process and return to the Planning Commission and City Council with recommendations for a General Plan Amendment and Zoning Ordinance for Condominium Conversions for possible action.

FISCAL IMPACT
None. This Council motion in itself will not create a fiscal impact.
