Subject/Title: Adopt a Resolution authorizing the City Manager to execute a contract amendment with Environmental Science Associates (ESA) for environmental consulting services for the CIP Project No. 542-5402, Solid Waste Transfer Station Improvements Phase III, in the amount not to exceed $51,561, plus a 10% project contingency, for a total contract amount of $107,317.10.

RECOMMENDATION
Adopt a Resolution authorizing the City Manager to execute a contract amendment with Environmental Science Associates (ESA) for environmental consulting services for the CIP Project No. 542-5402, Solid Waste Transfer Station Improvements Phase III, in the amount not to exceed $51,561, for a contract amount of $97,561 plus a 10% contingency for a new total contract amount of $107,317.10.

PREVIOUS ACTION
On May 25, 2004, by Resolution No. 2004-113, City Council approved the 2004/09 CIP Program that includes this project as part of the program.

On January 25, 2005, by Resolution No. 2005-20, City Council approved a contract with Carlton Engineering for schematic design work.

BACKGROUND
In a continuing effort to improve the operational efficiency of the City’s Solid Waste Transfer Station and to improve our ability to allow for limited public access, staff has been working to make significant changes to the site. Most notably, the operation will move under roof, an aboveground loading process will be constructed and we will expand the footprint of the dump pad to accommodate the expected growth to build out for the City.

On July 1, 2004, staff entered into an agreement with ESA for the necessary environmental review work (Initial Study/Mitigated Negative Declaration) In the amount of $46,000. This study was circulated through the state clearinghouse and various local agencies, as well as being made available to the general public for comment. The next phase of work consists of responding to comments and working with the Army Corp of Engineers, the Regional Water Quality Control Board and the Department of Fish and Game and also the California Integrated Waste Management Board that requires specific data to be included within the CEQA document (see attached ESA proposal). All of this work is necessary to obtain the required approvals for staff’s ability to move forward with the project.

In order to continue with the work, it is staff’s recommendation to approve the amendment with ESA Associates to complete the environmental review and response process as well as additional environmental services necessary.

FISCAL IMPACT
The funding for this project, $107,317 derives from the Solid Waste Enterprise Fund and is included within the CIP Project 2004/05 - 2008/09 budget sheet.

RESOLUTION NO.

ADOPT A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT AMENDMENT AND A CHANGE ORDER WITH ENVIRONMENTAL SCIENCE ASSOCIATES (ESA) FOR ENVIRONMENTAL CONSULTING SERVICES FOR THE CIP PROJECT NO. 542-5402, SOLID WASTE TRANSFER STATION IMPROVEMENTS PHASE III, IN THE AMOUNT NOT TO EXCEED $51,561, PLUS A 10% PROJECT CONTINGENCY, FOR A TOTAL CONTRACT AMOUNT OF $107,317.10.

WHEREAS, on May 25, 2004, the City Council approved the 2004/09 CIP Program which includes this project as part of the program; and

WHEREAS, the City’s Solid Waste Division must expand their Solid Waste Transfer Station’s ability to safely and efficiently process the expected increased volumes of material due to the City’s growth; and

WHEREAS, staff continues to work toward the completion of the Initial Study/Mitigated Negative Declaration as a necessary step to develop project documents; and

WHEREAS, in order to continue with the project, staff recommends approving an amendment with the project’s environmental consultant, ESA.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, authorize the City Manager to execute a contract amendment with ESA for environmental consulting services for the CIP Project No. 542-5402, Solid Waste Transfer Station Improvements Phase III, in the amount not to exceed $51,561 for a total contract amount of $107,317.10 including project contingency.
