Adopt a Resolution authorizing the City Manager to execute a contract
amendment with Legg, Inc., for additional security hardware and doors in the
amount of $20,194, plus a 10% contingency for the New Police Station, CIP
Project No. 337-3142.
On July 8, 2003, City Council directed staff to begin due diligence for a
possible site relocation to 9100 Brentwood Boulevard.
On September 9, 2003, City Council authorized the City Manager to transfer
funds in an amount
not to exceed $160,351 from the current project to the New Police Station
project in order to separate costs associated with the due diligence
On September 17, 2003, City Council authorized the City Manager to execute a
purchase agreement for a note and deed of trust secured by property located
at 9100 Brentwood Boulevard.
On February 10, 2004, City Council authorized staff to execute an agreement
for design services for the New Police Station with Kaplan McLaughlin Diaz (KMD)
in an amount not to exceed $673,363 and amended the 2003/04 – 2007/2008 CIP
On November 9, 2005, City Council awarded the contract to Legg, Inc. for the
New Police Station (Group C), Bid Package #21 – Detention Equipment for the
amount of $146,000.
As directed by the City Council on February 10, 2004, staff began the design
work for the New Police Station project. This project has been bid as a
As a portion of the multi-prime project, Legg, Inc. was awarded the bid for
detention doors, hardware and related equipment. During the design and
review phase, two detention door systems were specified in the drawings, but
were not identified within the scope of work in the contract documents. This
was an oversight during the design/review process. Because of the relatively
small amount of Legg, Inc.’s original bid, there are insufficient funds
within the contract contingency requiring this Council action of a contract
The fiscal impact associated with the New Police Station project is $20,194,
plus a 10% contingency, for a total not-to-exceed amount of $22,213.40 and
is included within the project budget, which was submitted and approved by
the City Council. Legg, Inc.’s total contract for the project is $166,194
including contingencies is now $182,813.40.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD AUTHORIZING THE
CITY MANAGER TO EXECUTE A CONTRACT AMENDMENT WITH LEGG, INC. FOR ADDITIONAL
SECURITY HARDWARE AND DOORS IN THE AMOUNT OF $20,194, PLUS A 10% CONTINGENCY
FOR THE NEW POLICE STATION, CIP PROJECT NO. 337-3142.
WHEREAS, an oversight occurred during the design of the project which didn’t
include the total amount of doors and hardware within the bid documents; and
WHEREAS, Legg, Inc.’s original bid did not include sufficient contingency to
cover the costs associated with the additional doors and equipment that were
omitted from the contract documents; and
WHEREAS, staff recommends amending Legg, Inc.’s contract to include the work
by a contract amendment.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood
that the City Manager is authorized to execute a contract amendment with
Legg, Inc. for additional security hardware and doors in the amount of
$20,194, plus a 10% contingency for the New Police Station, CIP Project No.
337-3142 for a total contract amendment including contingency in the amount
PASSED, APPROVED AND ADOPTED by the City Council of the City of Brentwood at
a regular meeting on the 10th day of May 2005 by the following vote:
This Amendment is entered into on May 10, 2005, by and between the City of
Brentwood and Legg, Inc.
WHEREAS, on the 9th Day of November 2004, the City of Brentwood entered into
a contract with Legg, Inc., A California Corporation to obtain Construction
Services included within Bid Package #21, Group C, Detention Equipment for
CIP Project No. 337-3142, New Police Station.
NOW, THEREFORE, IT IS AGREED as follows:
1. Article 5, of the original contract, entitled Contract Sum is amended to
increase the contract amount to $166,194.
2. All other terms remain unchanged.
