Subject/Title: Adopt a Resolution terminating the Contract with Raines, Melton & Carella, Inc. for Design Services for the Chloramination of Wells, CIP Project No. 562-5617, and execute a Contract with Camp Dresser and McKee, Inc. to provide Design Services for the Chloramination of Wells project.

RECOMMENDATION
Adopt a Resolution terminating the Contract with Raines, Melton & Carella, Inc. for Design Services for the Chloramination of Wells, CIP Project No. 562-5617, and execute a Contract with Camp Dresser and McKee, Inc. to provide Design Services for the Chloramination of Wells project, in the amount of $110,330, plus a 10% contingency.

PREVIOUS ACTION
On May 28, 2002, by Resolution No. 2549, City Council adopted the City’s 2002/03 – 2006/07 Capital Improvement Program that included the Chloramination of Wells, CIP Project No. 562-5617.

On May 27, 2003, by Resolution No. 2868, City Council adopted the City’s 2003/04 – 2007/08 Capital Improvement Program that included the Chloramination of Wells, CIP Project No. 562-5617.

On May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included the Chloramination of Wells, CIP Project No. 562-5617.

On January 11, 2005, by Resolution No. 2005-6, the City Council authorized the City Manager to execute a Professional Services Agreement with Raines, Melton & Carella, Inc., to provide Design Services for the Chloramination of Wells, CIP Project No. 562-5617.

BACKGROUND
Raines, Melton and Carella, Inc. (RMC) services were obtained to assist City staff in preparing the necessary construction documents as well as provide assistance to the City on a public notification process. Within several weeks of this contract being executed, the project manager for RMC left the firm and subsequently the project schedule began to suffer. Several discussions took place to rectify the situation; however, it became apparent that it was in the best interest of the City to terminate this agreement and hire another firm to complete the work.

Staff is recommending the firm of Camp Dresser and McKee (CDM) to assume this work and complete the project. They have completed numerous projects of this type throughout the Bay Area and are well qualified for this work. City staff has already worked successfully with the project team proposed by CDM on such projects as the Long Term Water Treatment Options Study, the Surface Water Treatment Facility Phase II – Design and the 2004 Water Master Plan Update and is confident that they will remain intact throughout the duration of this contract.

FISCAL IMPACT
The previous contract with RMC was for $143,022, of which there is approximately $120,000 remaining; thus providing sufficient funds to complete this work without any budget amendments. Included in the proposal from CDM is design of the facilities, public outreach assistance, services during construction and record drawings. The total cost of this proposal is $110,330, which has been included in the approved 2004/05 - 2008/09 Capital Improvement Program Budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TERMINATING THE CONTRACT WITH RAINES, MELTON & CARELLA, INC. FOR DESIGN SERVICES FOR THE CHLORAMINATION OF WELLS, CIP PROJECT NO. 562-5617, AND EXECUTE A CONTRACT WITH CAMP DRESSER AND MCKEE, INC. TO PROVIDE DESIGN SERVICES FOR THE CHLORAMINATION OF WELLS PROJECT, IN THE AMOUNT OF $110,330, PLUS A 10% CONTINGENCY.


WHEREAS, On May 25, 2004, by Resolution No. 2004-113, City Council adopted the City’s 2004/05 – 2008/09 Capital Improvement Program that included the Chloramination of Wells, CIP Project No. 562-5617; and

NOW, THEREFORE BE IT RESOLVED that the contact with Raines, Melton & Carella, Inc. for Design Services for the Chloramination of Wells, CIP Project No. 562-5617 be terminated.

BE IT FURTHER RESOLVED that the City Manager be authorized to execute a contract with Camp Dresser and McKee, Inc. to provide Design Services for the Chloramination of Wells project, in the amount of $110,330, plus a 10% contingency.
