Subject/Title: Adopt a Resolution accepting the Work Performed by Cassani Landscaping, for the Landscaping Project for Water (Potable) System Facilities, CIP Project No. 562-5634.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Cassani Landscaping, for the Landscaping Project for Water (Potable) System Facilities, CIP Project No. 562-5634, and direct the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
On June 22, 2004, City Council approved Resolution No. 2004-140, to include the Landscaping Project for Water (Potable) Systems Facilities into the 2004/05 – 2008/09 Capital Improvement Program.

On October 26, 2004, City Council approved Resolution No. 2004-248, authorizing the City Manager to sign a construction contract with Cassani Landscaping, for the Landscaping Project for Water (Potable) System Facilities, CIP Project No. 562-5634.

BACKGROUND
The project site is located in the Shadow Lakes Subdivision on Presidio Drive. The work for this project consisted of landscape screening, including a solar powered irrigation system, 107 trees and natural grass hydro-seed, to minimize any potential visual impacts to the adjacent residents. The work consisted of the installation of an irrigation system and the planting of 24” box trees and 15-gallon size trees to provide an immediate benefit to adjacent residents.

The Contractor completed all punch list items in December 2004 and has completed the 90-day maintenance period. The project is now ready for final acceptance.

FISCAL IMPACT
The funds for this work are paid for through enterprise fees, which are included in the existing budget as approved by this year’s Capital Improvement Program 2004/05, for a total project cost of $185,000.

The original construction contract for the Landscaping Project for Water (Potable) System Facilities was $51,682, with a 10% contingency of $5,168, for a total contract amount of $56,850, funded through enterprise fees per the approved City Budget. The total completion cost of this project is $51,682. There are sufficient funds to accommodate this landscaping contract in the overall budget. The project was completed without using any of the allotted contingency.

The annual maintenance cost is estimated at $900 a year. This cost will be funded by Landscaping and Lighting District No. 97-1.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY CASSANI LANDSCAPING FOR THE LANDSCAPING PROJECT FOR WATER (POTABLE) SYSTEM FACILITIES, CIP PROJECT NO. 562-5634, AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.

WHEREAS, on October 26, 2004, City Council approved Resolution No. 2004-248, awarding the construction contract for the Landscaping Project for Water (Potable) System Facilities, CIP Project No. 562-5634, to Cassani Landscaping and authorized the City Manager to execute the agreement and necessary documents in the amount of $51,682, plus a 10% contingency; and

WHEREAS, the work, including the final punchlist and 90-day maintenance period was completed in March of 2005 and is now ready for acceptance.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the work performed by Cassani Landscaping for the Landscaping Project for Water (Potable) System Facilities, CIP Project No. 562-5634, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for this project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did on the 26th day of October 2004 enter into an agreement with Cassani Landscaping, for the Landscaping Project for Water (Potable) System Facilities, CIP Project No. 562-5634. The project site is located in the Shadow Lakes subdivision on Presidio Drive. The work for this project consisted of landscape screening including a solar powered irrigation system, 107 trees and natural grass hydro-seed, to minimize any potential visual impacts to the adjacent residents. The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete the said project.

On the 22nd day of March 2005, the said contract as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
