Subject/Title: Adopt a Resolution approving the Speed Limits for Roundhill Drive, Atherton Boulevard and a section of Brentwood Boulevard/State Highway 4 from Fir Street to the southeast city limits, within the City of Brentwood.

RECOMMENDATION
Adopt a Resolution approving the speed limits for Roundhill Drive, Atherton Boulevard and a section of Brentwood Boulevard/State Highway 4 from Fir Street to the southeast city limits, within the City of Brentwood.

PREVIOUS ACTION
On February 10, 2004, City Council approved Resolution No. 2004-30, to establish speed limits on various roadway segments.

BACKGROUND
The California Vehicle Code Sections 22354, 22355, 22357, 22358 and 40802, requires local agencies to perform engineering and traffic surveys in order to enforce the speed limit by the use of radar.

Whenever the local agency builds new roadways, the local agency may by ordinance determine and declare the appropriate speed limit of 25, 30, and 35 miles per hour, whichever is found most appropriate with an engineering traffic survey. To provide proper circulation and improve safety for the public, staff performed engineering and traffic surveys on Roundhill Drive and on Atherton Boulevard. After analyzing the engineering and traffic survey, the Traffic Engineer determined the recommended speed limits of 25 miles per hour for Roundhill Drive and Atherton Boulevard.

The State of California, Department of Transportation performed engineering and traffic surveys on Brentwood Boulevard/State Highway 4. The State has determined that the speed limit should be reduced to 40 miles per hour from the present 45 miles per hour on the section of Brentwood Boulevard/State Highway 4 from Fir Street to the southeast city limits.

FISCAL IMPACT
The cost of installing appropriate speed limit signs is included in the City’s Public Works operating budget.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD TO AUTHORIZE THE CITY MANAGER TO APPROVE THE SPEED LIMITS FOR ROUNDHILL DRIVE AND ATHERTON BOULEVARD AND BRENTWOOD BOULEVARD/STATE HIGHWAY 4 FROM FIR STREET TO THE SOUTHEAST CITY LIMITS, WITHIN THE CITY OF BRENTWOOD.


WHEREAS, Division 11, Chapter 7, Article 1 of the California Vehicle Code (Section 22348 et seq.) provides the mechanism for local authorities to “determine and declare” a prima facie speed limit on the basis of an engineering and traffic survey; and

WHEREAS, Title 10, Chapter 10.04 of the Brentwood Municipal Code (Section 10.04.010 et esq.) describes a procedure for the establishment of such regulations; and

WHEREAS, engineering and traffic surveys were prepared from September 2004 to January 2005; and

WHEREAS, after analyzing the engineering and traffic survey, the Traffic Engineer determined the recommended speed limits from the surveys.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood, that the prima facie speed limit determined by the engineering and traffic survey is hereby declared as follows:

BE IT FURTHER RESOLVED that the City Manager is hereby authorized to give direction to the City Engineer, per the California Vehicle Code Regulation, to establish the appropriate speed limits and to install the appropriate speed regulation signs.
