Subject/Title: Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading, Inc., for the construction of the Brentwood Boulevard Curve, CIP Project No. 336-3100.

RECOMMENDATION
Adopt a Resolution accepting the work performed by Bay Cities Paving & Grading, Inc., for the construction of the Brentwood Boulevard Curve, CIP Project No. 336-3100, and directing the City Clerk to file a Notice of Completion with the County Recorder.

PREVIOUS ACTION
In August 1999, City Council authorized the application for Hazard Elimination Safety Program funding in the amount of $450,000 for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On February 8, 2000, City Council authorized the application of Federal Surface Transportation Program funding for the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On May 28, 2002, City Council adopted the City’s 2002/03 - 2006/07 Capital Improvement Program that included the Brentwood Boulevard Curve, CIP Project No. 336-3100.

On August 27, 2002, City Council approved Resolution No. 2648, authorizing the City Manager to execute Program Supplement Agreement No. 005-M Administering Agency-State Agreement for the Brentwood Boulevard Curve, CIP Project No. 336-3100, for funds from both the Hazard Elimination Safety Program and the Federal Surface Transportation Program.

On May 13, 2003, City Council approved Resolution No. 2863, authorizing the City Manager to award the construction contract for the Brentwood Boulevard Curve, CIP Project No. 336-3100, to Bay Cities Paving & Grading, Inc. in the amount of $412,916.50, plus a 10% contingency.

On May 25, 2004, City Council approved a resolution authorizing the City Manager to execute a contract change order for installation of landscaping, retaining walls, and sound wall extension along properties fronting the Brentwood Boulevard Curve project (Liberty Union High School District, Safeway and Diablo Mini Storage) to Bay Cities Paving & Grading, Inc. for the Brentwood Boulevard Curve, CIP Project No. 336-3100, in an amount not to exceed $78,571.05 plus a 10% contingency.

BACKGROUND
This federally funded project realigned the Brentwood Boulevard 10 mph curve between Second Street and Pine Street at Safeway. The project modified the super-elevation to smooth out the curve, widen the travel lanes, install a raised median, and landscape both the median and parkway on both sides. The project was successful in reducing the risk of big rig trucks from overturning while executing this curve on Highway 4. The super-elevation and longer radius of the curve improved the overall safety at this curve.

The following is the scope of improvements that were constructed and inspected on the Brentwood Boulevard Curve. These improvements will be maintained by the Caltrans except City owned utilities, sidewalk, and landscaping areas.

• 23,700 square feet of asphalt concrete for roadway reconstruction
• 1,623 lineal feet of curb and gutter
• 7,100 square feet of sidewalk
• 6,250 square feet of landscape and irrigation
• 1,800 square feet of soundwall
• One street light
• Reconstruction of one brick and mortar sanitary sewer manhole
• 280 lineal feet of vertical retaining wall along Diablo Mini Storage

The contractor has met all the contractual requirements for the City to accept the work and has completed all necessary punch list items. This acceptance by the City Council is an administrative action necessary to formally close the project.

FISCAL IMPACT
The previously authorized construction contract with Bay Cities Paving & Grading, Inc. provided for the bid amount of $412,916.50 plus a 10% contingency.

A proposed change order of $78,571.05, plus a 10% contingency for a total change order amount of $86,428.15, was approved to provide for the additional landscaping, soundwall and retaining wall. The total project construction cost is $535,287.05 (includes 8.91 contingency used) and approximately 88% of the project cost will be reimbursed by Federal funding.

There are sufficient funds in the CIP Budget for the Brentwood Boulevard Curve, CIP Project No. 336-3100, in an amount of $865,000, to cover the construction cost for this contract and close out this project.

RESOLUTION NO.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BRENTWOOD ACCEPTING THE WORK PERFORMED BY BAY CITIES PAVING & GRADING, INC. FOR THE BRENTWOOD BOULEVARD CURVE, CIP PROJECT NO. 336-3100, AND DIRECT THE CITY CLERK TO FILE A NOTICE OF COMPLETION WITH THE COUNTY RECORDER.


WHEREAS, in August 1999, City Council authorized the application for Hazard Elimination Safety Program funding in the amount of $450,000 for the Brentwood Boulevard Curve, CIP Project No. 336-3100; and

WHEREAS, the required public improvements for the Brentwood Boulevard Curve, CIP Project No. 336-3100, have been completed and are in conformance with contract plans and specifications.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brentwood that the Brentwood Curve, CIP Project No. 336-3100, is hereby accepted.

BE IT FURTHER RESOLVED that the City Clerk is hereby directed to file a Notice of Completion with the County Recorder for the project.

NOTICE OF COMPLETION

NOTICE IS HEREBY GIVEN THAT:

THE CITY OF BRENTWOOD, a general law city, in the County of Contra Costa, State of California, did, on May 13 2003, enter into an agreement with Bay Cities Paving & Grading, Inc., for the construction of the Brentwood Boulevard Curve, CIP Project No. 336-3100; located on Brentwood Boulevard between Pine Street and Diablo Way, Brentwood, California.

The work described in the contract documents was to furnish all material, labor, and equipment necessary to complete the said project.

On February 22, 2005, the said contract, as a whole was completed and the work was accepted by the City Council of the City of Brentwood.

I hereby certify under penalty of perjury that the facts set forth in the foregoing Notice of Completion are true and correct.
